An Eulogy of Ibn Hazm Regarding the Method and Featured Opinions in the Sphere of Principles of the Religion

Öz

In Zâhirî school of thought, Ibn Hazm was considered as the biggest imam after Davud al- Zâhirî who was the founder of this sect. Ibn Hazm didn’t limit his method with only Ancillaries of the Faith but he also thought to practise it in the Sphere of Principles of the Religion. He implemented a single procedure in both areas His works regarding method which reached us today have been
known. His eulogy regarding method was found by some subsequenresearchers. His eulogy which was written as a poem consisted of 60
couplets includes Ibn Hazm’s opinions regarding the method. Autstanding
issues in this eulogy are: imitation, assumption, real information,
grass roots of Sharia, the informative value of the authentic Sunnah, the
necessity of Zâhirî method in understanding of the text of the Qur’an
and Hadith, accepted jurisprudence, methods of provisions extraction,
expounding, abrogation etc

İbn Hazm’ın Usul ile İlgili Bir Kasidesi ve Usûlu’d-din Yönünden Öne Çıkan Görüşler

İbn Hazm, Zâhiriliğin kendisine nisbet edildiği Davud ez- Zâhiri’den sonra mezhebin en büyük imamı olarak kabul edilir. O fıkhi konularda takip ettiği usûlü, sadece fürû’ ile sınırlandırmayıp, usûluddin konularına da tatbik etmeyi düşünmüş ve her iki alanda da bir tek usûl projesini hayata geçirmiştir. Onun Usul ile ilgili yazdığı eserlerden bugün elimizde olanları bilinmektedir. Ancak daha sonraları araştırmacılar tarafından onun usûl ile ilgili bir kasidesinin olduğu keşfedilmiştir. Bu kasidede İbn Hazm’ın usul ile ilgili görüşlerini 60 beyit halinde veciz bir şekilde şiire dökmüştür. Kasidede öne çıkan konular: taklit, zann, gerçek bilgi, edille-i şer’iyye, sahih sünnetin bilgi değeri, nassların zâhir yöntemiyle anlaşılması gerekliliği, makbul içtihat, makbul olmayan istinbat yöntemleri, te’vil, nesh gibi hususlar göze çarpmaktadır
