Öz

           Postinjection neuropathy is one of the common health problems
especially in developing countries, and also due to reasons of high morbidity.

It is necessary to distinguish the
complication/malpractice for this situation which emerged as a malpractice case
against the healthcare providers and the healthcare professionals should get
the necessary training and show necessary sensitivity in this regard. This
situation always presented as 'wrong needle shot, paralyzed' at the media and
is causing the accusation of healtcare providers. It was thought that there was a post-injection defect in this situation,
so it is a 'crime' and therefore there is a guilty. But in the last decade, it
has been seen as a complication in the forensic practice, the presence of the
indication of injection, the right place, the right medicine and the right
amount. For this reason, demonstrating this in patient records in cases where
such allegations are contingent will be useful for future legal cases.

Enjeksiyon Sonrası Gelişen Nöropati: Komplikasyon/Malpraktis Ayrımında İnce Bir Çizgi

Öz

              Enjeksiyon sonrası gelişen nöropati; özellikle
gelişmekte olan ülkelerde yaygın sağlık sorunlarından biri olmakla birlikte
yüksek morbiditeye sebep olması dolayısıyla da ayrıca önem arz etmektedir.

Sağlık çalışanlarının karşısına malpraktis davası
olarak çıkan bu durum için öncelikle komplikasyon/malpraktis ayrımı
yapılarak,  sağlık çalışanlarının da bu
konuda gerekli eğitimi alması, gerekli hassasiyeti göstermesi gerekmektedir.
Sağlık çalışanlarının suçlanmasına neden olan ve basında daima ‘yanlış iğne
vuruldu, felç oldu’ şeklinde sunulan bu durum hakkında enjeksiyon sonrası bir
kusur oluştuğu, öyleyse ortada bir ‘suç’ olduğu ve dolayısıyla bir de ‘suçlu’
olduğu şeklinde düşünülmekteydi. Ancak son yıllarda adli tıp uygulamalarında;
enjeksiyon endikasyonunun varlığı, doğru yer, doğru ilaç ve doğru miktarda
uygulandığında gelişebilecek olumsuz bir durumun komplikasyon olarak
değerlendirildiği görülmektedir. Bu nedenle, bu tür iddialar söz konusu olduğu
olgularda hasta kayıtlarında bu durumun gösterilmesi, ileride doğabilecek
hukuki durumlar için yararlı olacaktır.
