AB  - Bu çalışmanın amacı, felsefe tarihi açısından modern dönemin şafağında yaşamış İspanyol bir filozof olan Francisco de Vitoria’nın siyaset ve hukuk felsefesi kapsamında yer alan haklı savaş düşüncesini eleştirel bir perspektiften değerlendirmektir. Yine çalışma ikinci olarak kısmen de olsa ABD özelinde onun haklı savaş düşüncesinin günümüz dünyası ile olan ilişkisini ortaya koymayı amaçlamaktadır. Çalışmada Vitoria’nın haklı savaş düşüncesinin, Amerika kıtasındaki yerli halkları mülksüzleştirme politikalarına ve Avrupa yayılmacılığına meşruiyet kazandırdığı argümanı temellendirilmektedir. Çalışmada öncelikle onun açısından savaşı meşru olmaktan çıkaran haksız çerçeve tartışılmaktadır. Daha sonra Vitoria açısından savaşı meşru kılan haklı çerçeve ve bunun dayandığı felsefi kavram ve argümanlar irdelenmektedir. Çalışmada üç temel sonuca ulaşılmıştır. İlk olarak evrensel olduğunu düşündüğü doğal hukuk ve uluslararası hukuk düşüncesi doğrultusunda Vitoria’nın -Immanuel Wallersteincı bir kavramla- Avrupa Evrenselciliğini meşrulaştıran bir filozof olduğu sonucuna varılmıştır. Çalışmada ikinci olarak Vitoria’nın en temelde iletişim hakkı ve doğal ortaklık hakkını merkeze alan haklı savaş düşüncesinin yine Wallersteincı bir ifadeyle taraflı ve tahrif edilmiş bir evrenselcilik barındırdığı sonucuna ulaşılmıştır. Son olarak ABD özelinde değerlendirildiğinde günümüz dünyasında savaş ve hâkimiyet konularında hala Vitorian argümanların devreye konulmakta olduğu anlaşılmaktadır.

N2  - The aim of this study is to evaluate critically the just war thought of Francisco de Vitoria, a Spanish philosopher who lived at the dawn of the modern period in terms of the history of philosophy, within the scope of his own political and legal philosophy. Again secondly, the study partly aims to reveal the relationship of his just war thought with the contemporary world, with specific reference to the USA. The study grounds the argument that Vitoria's just war thought legitimizes the policies of dispossession of the native peoples in the Americas and the European expansionism. In the study, firstly the unjust framework that delegitimizes the war from his perspective is discussed. Then, the just framework that legitimizes war from Vitoria's perspective and the philosophical concepts and arguments on which it is based are examined. There are three basic conclusions in the study. Firstly, it has been concluded that Vitoria is a philosopher who legitimizes European Universalism -with an Immanuel Wallersteinian concept- in line with the natural law and international law thought that he considers to be universal. Secondly, the study concludes that the just war thought of Vitoria which is fundamentally centered on the right of communication and the right of natural partnership -again with a Wallersteinian statement- contains a partial and distorted universalism. Finally, when evaluated with specific reference to the USA, it is understood that Vitorian arguments are still being put into politics in the world we live in regarding war and sovereignty.
