AB  - Konsolosluk Mahkemeleri, hukukta modernleşme sürecinin önemli aşamalarından biridir. Batılı devletlerin iktisadi ve siyasi amaçları doğrultusunda Osmanlı Devleti’nin bazı eyaletlerinde konsolosluk mahkemeleri açmaları söz konusu olmuştur. Bu durumun en çarpıcı örnekleri Mısır ve Tunus’ta yaşanmıştır. Çok çeşitli mahkemelerin Osmanlı topraklarındaki varlığı bilinmektedir. Bu mahkemeler başta sadece yabancı tüccar ve tebaayı ilgilendiren davalara baksalar da sonradan daha geniş yetkilerle etkili olmaya başlamışlardır. Tunus'ta yargı sisteminin batılılaşması veya Batı'nın hukuk sistemine müdahalesi dönemini ele alacak olan bu çalışmanın amacı, öncelikle XIX. yüzyılda yargı-hukuk alanındaki modernleşme çalışmalarının Tunus’ta yansımasını Osmanlı Arşivi belgeleri ışığında incelemektir. Çalışma, özellikle Tunus'ta konsolosluk mahkemelerinin kurulması sırasında Osmanlı Devleti-Fransa-İngiltere-İtalya arasındaki diplomatik ve siyasi gelişmeleri arşiv belgeleri ile ortaya koymayı amaçlamaktadır. Bu başlık altında, XIX. yüzyılın değişim rüzgarıyla Tunus'un idari ve sosyal yapısında meydana gelen değişimler, suç ve suçlu kavramları, Batı'nın mahkemeler ve yargı kurumları üzerindeki etkisi tarih perspektifinden anlaşılmaya çalışılmış ve emperyalizmin bölgeye hukukla müdahalesinin sonuçları değerlendirilmiştir. Osmanlı Devleti’nin ise Tunus’taki hakimiyetini ve bölgedeki hukuki üstünlüğünü koruma mücadelesi ve bölgedeki hukuki varlığını sürdürme çabaları araştırmanın temel konusudur. Avrupalı devletlerin iktisadi işgallerini resmileştirmenin ve kalıcı hale getirmenin bir yöntemi olarak hakim devlet anlayışını nasıl yok saydıkları ve işgallerini kolaylaştırmak için hukuki adımların hangi yöntemler ile gerçekleştirdikleri incelenmiştir.

N2  - Consular Courts are one of the important stages of the modernization process in law. European powers opened consular courts in some provinces of the Ottoman Empire in line with their economic and political objectives. These courts initially dealt only with cases concerning foreign merchants and subjects, they later became effective with wider powers. The aim of this study, which will deal with the westernization of the judicial system in Tunisia or the period of Western intervention in the legal system, is to examine the reflection of the modernization efforts in the field of judiciary-law in Tunisia in the nineteenth century. The study aims to reveal the diplomatic and political developments between the Ottoman Empire-France-Britain-Italy, especially during the establishment of consular courts in Tunisia through archival documents. Under this heading, the changes in the administrative and social structure of Tunisia with the winds of change in the XIXth century, the concepts of crime and criminals, the influence of the West on courts and judicial institutions will be tried to be understood from the perspective of history and the results of imperialism's intervention in the region through law will be evaluated. The struggle of the Ottoman Empire to maintain its sovereignty in Tunisia and its legal supremacy in the region will be analyzed and its efforts to maintain its presence in the region will be the main subject of the research. It will be examined how the European States ignored the understanding of the dominant state as a method of formalizing their economic occupation and making it permanent, and the methods by which legal steps were taken to facilitate their occupation.
