AB  - Ö Z E T Bu çalışma, Türkiye işgücü piyasasının istihdam koruma yapısını, OECD İstihdam Koruma Mevzuatı (EPL) endeksleri üzerinden karşılaştırmalı bir perspektifle analiz etmektedir. Çalışma, Türkiye’nin hem düzenli çalışanlar (EPR) hem de geçici çalışanlar (EPT) için yasal koruma katılığı bakımından OECD ortalamasının oldukça üzerinde bir konumda olduğunu göstermektedir. Özellikle kıdem tazminatı yükümlülükleri ve iş güvencesi tazminatı gibi maliyet kalemlerinin yüksekliği dikkat çekerken, deneme süresinin kısa süreli olması işçinin koruma şemsiyesine çok erken dahil olmasına neden olmaktadır. Bu durum, piyasa esnekliği ve ekonomik verimlilik tartışmalarıyla ilişkilendirilmektedir. Türkiye’de sosyal diyalog ve çalışan katılımı mekanizmalarındaki yapısal eksiklikler, sistemin zayıf yönü olarak tanımlanmaktadır. Çalışmada kullanılan senaryo analizi yöntemiyle, mevcut yasal katılıkları "güvenceli esneklik" (flexicurity) modeline geçişin potansiyel çıktıları üzerinden tartışılmaktadır. Sonuç olarak, Türkiye için sadece yasal korumayı değil, aktif işgücü piyasası politikaları ve güçlendirilmiş işsizlik sigortası mekanizmalarını içeren bir kurumsal tamamlayıcılık modeli önerilmektedir.

N2  - A B S T R A C TThis study analyzes the employment protection structure of the Turkish labour market through a comparative perspective based on the OECD Employment Protection Legislation (EPL) indices. The study demonstrates that Turkey maintains a position significantly above the OECD average in terms of regulatory strictness for both regular (EPR) and temporary (EPT) employment. While the high level of cost items such as severance pay obligations and unfair dismissal compensation is noteworthy, the short duration of the trial period results in workers being included in the protection umbrella at a very early stage. This situation is associated with debates on market flexibility and economic efficiency. Structural deficits in social dialogue and employee participation mechanisms in Turkey are identified as the weak points of the system. Using the scenario analysis methodology, the study discusses existing legal rigidities through the potential outcomes of transitioning to a "flexicurity" model. Consequently, an institutional complementarity model is proposed for Turkey, incorporating not only legal protection but also active labour market policies and strengthened unemployment insurance mechanisms.
