AB  - Anayasalcılıkve demokrasi, farklı kökenlere sahip olan iki kavramdır. Kaynağını AntikDünya’dan alan demokrasi, halk egemenliğine dayanır. Öte yandan anayasalcılıkteorisi siyasi iktidarı, kaynağı kim olursa olsun, sınırlandırmak vekısıtlamakla ilgilenmektedir. Her ne kadar ikisinin arasındaki bir çatışmakaçınılmaz gözükse de, bir arada var oluşa giden bir yol da vardır. Bu yol,demokrasinin var oluşundan önce gelen gerekleri olan siyasi eşitlik ve özgürlükpusulasının yardımıyla bulunabilir. İnsan tecrübesi, yığınların ve onlarıntemsilcilerinin de mutlak krallar kadar tiranlığa yatkın olduğunugöstermektedir. Dahası anayasalcılık, halk iradesi yoluyla demokratikmeşruiyete sahip olabilir. Dolayısıyla demokratik yöntemlerle kabul edilmişanayasalar, en az yasama organınca çıkarılan kanunlar kadar meşru görülmelidir.Üstüne üstlük, anayasaların olağan yasaları yapan çoğunluklarcadeğiştirilememesi gayrimeşru görülemez; bu da bizi başa, demokrasinin varoluşundan önceki gereklerine götürür. Bununla beraber, illiberal demokrasiçağında anayasalcılığın demokrasiyi ve hakları koruyucu konumu sorgulanmayaaçık bir niteliktedir.

N2  - Democracy and constitutionalism are two concepts the origins of which aredifferent. Democracy, which has its origins from Ancient World, rests onpopular sovereignty. On the other hand, constitutionalist theory is interestedin limiting and constraining that sovereignty regardless of its source. Howeverit seems inevitable to have a conflict between the two, there is also a way tomutual existence. This way could be found with the help of the compass ofpre-existence needs of democracy which are political equality and freedom.Human experience shows that the masses and their representatives are inclinedto tyranny as much as absolute kings. Furthermore, constitutionalism could havedemocratic legitimacy through popular will. Thus, democratically enactedconstitutions should be regarded no less legitimate than laws passed bylegislative. Additionally, notto let constitutions be amended by the same majorities who could enact ordinarylaws could not be regarded as illegitimate, which brings us back to thebeginning, namely, to the protection of pre-existence needs of democracy.Nevertheless, in the era of illiberal democracy, the status ofconstitutionalism as a protector of democracy and rights could be questioned.
