AB  - Inthe post 1999 era, although a number of minority issues have been resolvedbetween Turkey and Greece, no progress has been made on the issue of theelection of muftis in Greece. Inspite of the presence of Protocol No. 3 that was annexed to the 1913 Treaty ofAthens, which recognizes the right of Muslims to elect their muftis, Greece argues that the Treaty ofAthens and Protocol No. 3 are invalid. The underlying reason for this argumentis the fear stemming from the extensive secular and judicial authorities of themuftis and the possibility ofpoliticization of their authority. This paper aims to discuss the validity ofthe 1913 Treaty of Athens and Protocol No. 3 and to examine relevantinternational treaties on the election of muftis.The paper further aims to explain the positions of Turkey and Greece andongoing developments on this issue.

N2  - Her ne kadar 1999 sonrası dönemde Türkiye veYunanistan arasında azınlıklarla ilgili birçok sorun çözüme kavuşturulmuş olsada, Yunanistan’daki müftülerin seçimle işbaşına gelmeleri konusunda herhangibir olumlu gelişme yaşanmamıştır. Müslümanların müftülerini seçme hakkınıtanıyan 1913 Atina Antlaşması’na Ek 3 Numaralı Protokol’ün varlığına rağmen, Yunanistan,Atina Antlaşması ile Antlaşma’ya Ek 3 Protokol’ün geçerli olmadığınısavunmaktadır. Bu iddianın gerisinde, müftülerin seçimle işbaşına gelmelerihalinde geniş dünyevî ve yargısal yetkilere sahip müftülük kurumununsiyasallaşacağı endişesi yatmaktadır. Bu çalışma, 1913 Atina Antlaşması veAntlaşma’ya Ek 3 Numaralı Protokol’ün geçerliliğini tartışmayı ve müftülerinseçimle işbaşına gelmeleriyle ilgili diğer uluslararası antlaşmaları incelemeyiamaçlamaktadır. Çalışmada, ayrıca, konuyla ilgili olarak Türkiye veYunanistan’ın politikaları ile yaşanan gelişmeler aktarılacaktır.
