The introduction of individual applications to the Constitutional Court has been a significant step forward in protecting fundamental rights and freedoms. This mechanism has introduced new concepts, institutions and principles to the procedural law of constitutional jurisdiction, while also sparking various legal debates. Studies in the literature on the procedural aspects of individual applications have predominantly focused on admissibility, examination of the merits, violation judgements and execution of such decisions. However, the decision to strike an application out of the Court’s list, which is frequently encountered in general judicial procedures, is also among the decisions that the Court may render in individual applications. This article examines the legal nature of decisions to strike out cases from the list and the grounds for such decisions, adopted in Law No 6216 on The Establishment and Procedures of the Constitutional Court, The Rules of Procedure of the Constitutional Court and adopted by the case-laws of the Constitutional Court. The abstract and framework nature of the provisions in the Law and the Rules of Procedure makes the Court’s case law decisive. Nevertheless, it is not possible to conduct an exhaustive analysis, given the large number of decisions. For this reason, the study focuses on decisions considered instructive or thought to indicate methodological or interpretative changes, with the aim of contributing to procedural constitutional jurisdiction.
Anayasa Mahkemesine bireysel başvuru hakkı ile temel hak ve özgürlüklerin korunması bakımından önemli bir ilerleme sağlamıştır. Bu süreç, anayasa yargısının usul hukukuna yeni kavram, kurum ve ilkeler kazandırmış; beraberinde çeşitli hukuki tartışmaları da getirmiştir. Literatürde bireysel başvuru usulüne ilişkin çalışmaların çoğunlukla kabul edilebilirlik koşulu, esas incelemesi, ihlal kararları ve bu kararların icrası üzerinde yoğunlaştığı görülmektedir. Oysaki genel yargılama usullerinde sıklıkla karşılaşılan düşme kararı da Mahkemenin bireysel başvuruda verebileceği kararlardan biridir. Bu makale, 6216 sayılı Anayasa Mahkemesinin Kuruluş ve Yargılama Usulleri Hakkında Kanun ve Anayasa Mahkemesi İçtüzüğü ile düzenlenen düşme kararının hukuki niteliğini ve düşme sebeplerini ele almaktadır. Kanun ve İçtüzükte yer alan soyut düzenlemeler, Mahkeme içtihatlarını belirleyici hâle getirmektedir. Ancak kararların niceliği dikkate alındığında tüketici bir inceleme yapma olanağı bulunmamaktadır. Bu nedenle çalışma kapsamında, öğretici nitelikte olduğu değerlendirilen ve yöntem veya yorum değişikliğine işaret ettiği düşünülen kararlar ekseninde bir değerlendirme yapılmış; anayasa usul hukukuna katkıda bulunmak amaçlanmıştır.
