                                                                                                <abstract><p>Bu makale, Polonya ve uluslararası hukuk çerçeveleri, içtihatlar, ampirik araştırmalar ve literatürden elde edilen bilgiler ışığında, 2015-2023 yılları arasında Polonya&#039;da yargısal direniş kavramını eleştirel bir bakış açısıyla incelemektedir. Çalışma, yargısal direnişi tanımlamak ve diğer yargı tutumlarından ayırmak, hukuki niteliğini incelemek ve yargıçlar için bunun bir hak veya ödev olup olmadığını değerlendirmek amacıyla yapılmıştır. Makale, yargı bağımsızlığını ihlal eden ve yasaları çiğneyen siyasi girişimlere karşı yargıçların toplu ve bireysel, mahkeme içi ve dışı eylemlerine vurgu yaparak yargısal direnişin tanımını ortaya koymaktadır. Öngörülen temel kriter, yargı bağımsızlığını ihlalin ulusal standartlara göre meşruiyet taşımaması ve bu hususun teyit edilmiş olmasıdır. Bunu desteklemek için makalede hem ulusal hem de uluslararası kuruluşların değerlendirmelerine atıfta bulunulmaktadır. Bulgular, yargı bağımsızlığının bir unsuru olarak yargısal direnişin daha geniş ölçüde normatif anlamda kavramsallaştırılmasının potansiyel bir gereklilik olduğunu göstermekte ve bunun hukukun üstünlüğünün gelecekte aşınmasına karşı muhtemel bir koruma önlemi olduğuna işaret etmektedir.</p></abstract>
