Abstract

The criminal procedure of the United States of America (USA) used for ascertaining
the truth is different from criminal procedure used in Turkey. In the U.S.A., the
responsibility of goverment for its criminal process is fullfilled by giving extensive
power to prosecutors and bringing the public in as jurors to keep the system accountable.
In the U.S.A. criminal procedural system, if the accused does not willingly
plead guilty, guilt must be proven “beyond a reasonable doubt”. The term “beyond
a reasonable doubt” doesn’t exist in the Turkish criminal procedurel system.
Technological improvements have increased the capabilities of perpetrators and
crimes go far beyond national borders. Because transnational crimes are prosecuted
by more than one country, learning other countries’ legal systems is indispensable.
This article gives information on doubt which has to be overcome in order to reach
proof in different criminal procedural systems, and examines its application in the
U.S.A. and Turkey.

Ceza Yargılamasında İspat İçin Yenilmesi Gereken Şüphe; Türkiye ve Amerika Birleşik Devletleri Sistemlerinin İncelenmesi

Abstract

Maddi gerçeği ortaya çıkarma konusunda Amerika Birleşik Devletleri (ABD) ceza
usulü, Türk ceza usulünden farklıdır. ABD’de ceza yargılamasına ilişkin devlet
sorumlukları, önemli yetkilerle donatılmış savcılar tarafından yerine getirilmekte
ve sistemi kamuya hesap verebilir tutmak için jüri yargılama sürecine dâhil edilmektedir.
Suçlanan kendi rızası ile suçunu kabul etmez ise, suçun “makul şüphenin
ötesinde” ispatlanması gerekmektedir. “Makul şüphenin ötesinde” kavramı Türk
ceza yargılaması sisteminde bulunmamaktadır.
Gelişen teknoloji imkânları artırmakta ve suçlar sınır ötesine taşmaktadır. Sınırı
aşan suçlar birden fazla ülke tarafından soruşturulduğundan, diğer ülkelerin ceza
yargılama sistemlerini de öğrenmek kaçınılmaz olmaktadır. Makale, farklı ceza
muhakemesi sistemlerinde ispat için yenilmesi gereken şüphe konusunda bilgi vererek
Türkiye ve ABD uygulamasını incelemektedir.
