Family Mediation Training: The Example of England

Abstract

Family mediation, which is one of the alternative dispute resolution methods, is preferred in the resolution of family disputes and is successfully applied in comparative law. Although there are many reasons for the successful implementation of this method, the training of the family mediator is of great importance in this sense. As it is known, the mediation method requires training in itself. However, this type of mediation requires additional training beyond the requirements of basic mediation training. As of today, there is no separate legal regulation on family mediation in our country. Therefore, there is no additional training on family mediation. However, it is seen that many workshops, congresses and seminars are organized on family mediation. The UK is one of the pioneer countries in implementing family mediation at a professional level. It has long been known that family mediation has gained an institutional identity both in terms of education and practice in this country. In our study, we believed that it would be beneficial to address the issue of family mediation training in England, and examined the issue specifically in this country. In terms of our country, we hope that the study will be able to give an idea to the legal regulations to be made on this issue.

AİLE ARABULUCULUĞU EĞİTİMİ: İNGİLTERE ÖRNEĞİ

Abstract

Alternatif uyuşmazlık çözüm yöntemlerinden biri olan arabuluculuğun aile uyuşmazlıklarının çözümünde tercih edilen aile arabuluculuğu mukayeseli hukukta başarılı bir şekilde uygulanmaktadır. Bu yöntemin başarılı bir şekilde uygulanmasının birçok sebebi olsa da aile arabulucusunun eğitimi bu anlamda büyük önem arz etmektedir. Bilindiği üzere, arabuluculuk yöntemi başlı başına bir eğitim gerekmektedir. Ancak arabuluculuğun bu türünde temel arabuluculuk eğitiminin gereksinimlerinden başka birtakım ek eğitimlere ihtiyaç duyulmaktadır. Ülkemiz açısından bugün itibariyle aile arabuluculuğuna ait müstakil olarak bir hukuki düzenleme bulunmamaktadır. Dolayısıyla aile arabuluculuğuna dair herhangi bir ek eğitim de yoktur. Ancak aile arabuluculuğu konusunda çok sayıda çalıştay yapıldığı, kongre ve seminerler düzenlendiği görülmektedir. İngiltere aile arabuluculuğunu profesyonel düzeyde uygulayan ve bu konuda öncü olmuş ülkelerden biridir. Aile arabuluculuğun bu ülkede gerek eğitim anlamında gerekse uygulama anlamında kurumsal bir kimliğe kavuştuğu öteden beri bilinmektedir. Biz de çalışmamızda aile arabuluculuğu eğitimi konusunu İngiltere üzerinden ele almanın yararlı olacağı kanaatiyle bu ülke özelinde konuyu inceledik. Ülkemiz açısından ise çalışmanın bu konu ile ilgili yapılacak hukuki düzenlemelere bir fikir verebilmesini temenni
