İstifleme Bozukluğunun Adli Yönü: Bir Olgu Sunumu

Abstract

Aşırı toplama ve biriktirme, toplanan nesneleri atmada başarısızlık olarak tanımlanan istifleme, çok eski yıllardan bu yana bilinmesine rağmen ilk kez Mental Bozuklukların Tanısal ve İstatistiksel El Kitabı-5 /DSM 5’de obsesif kompulsif bozukluk (OKB) ve ilişkili bozukluklar başlığı altında ayrı bir tanı kategorisi olarak yer almıştır. İstifleme bozukluğu hastaların yaşamını olduğu kadar aile bireylerinin yaşamını da olumsuz olarak etkilemektedir. Epidemiyolojisi, etiyolojisi, tedavisi konusunda tam bir görüş birliği olmayan istifleme bozukluğunun adli yönü de yeterince bilinmemektedir. Bu çalışmada eşyaları istifleme davranışı olan ve çocuklarını çamaşır suyu ile yıkaması sonucu çamaşır suyundan zehirlenen çocuğunun hastane başvurusu olduğu öğrenilen kadın hasta sunulmuştur. Ceza Muhakemesi Kanunu (CMK)’nun 74.maddesi uyarınca servisimize zorunlu yatışı yapılarak, Türk Ceza Kanunu (TCK) 32. maddesi kapsamında ceza sorumluluğu değerlendirilmesi istenen olgunun hastalık öyküsü ve klinik seyri mevcut literatür bulguları ışığında tartışılmıştır. İstifleme bozukluğu ile ilgili yasal düzenlemeler ve klinisyenlerin konu ile ilgili farkındalığı önemlidir.

Forensic Aspects of Hoarding Disorder: A Case Report

Abstract

Although hoarding, defined as excessive collecting and hoarding and failure to throw away collected objects, has been known for many years, it was first included in the Diagnostic and Statistical Manual of Mental Disorders-5 / DSM-5 under the title of obsessive compulsive disorder (OCD) and related disorders was included as a diagnostic category. Hoarding disorder negatively affects the life of the patients as well as the life of family members. The forensic aspect of hoarding disorder, for which there is no consensus on its epidemiology, etiology and treatment, is not well known. In this study, a female patient who had hoarding behavior and whose child was poisoned by bleach as a result of washing her children with bleach was presented. The disease history and clinical course of the patient, who was compulsorily admitted to our service in accordance with Article 74 of the Criminal Procedure Code (CPC) and requested to be evaluated for criminal liability within the scope of Article 32 of the Turkish Criminal Code (TCC), were discussed in the light of available literature findings. Legal regulations regarding hoarding disorder and clinicians' awareness of the issue are important.
