The Legal Regime of Islands under Unclos: New Developments and Challenges

Abstract

Disputes over sovereignty and the delimitation of maritime zones of islands has replaced traditional maritime boundary disputes between coastal and island states. This is due new developments and challenges to the regime especially since UNCLOS 1982. Reasons for these devel-opments include the: resurgence of maritime nationalism; legacy of arbitrarily-drawn colonial boundaries; scramble for marine natural resources; clamber for renewable energy resources from these islands; emergence of the blue economy; effect of global warming on the island states; and national defence and security concerns. Foremost, among the disputed areas are the conflicting claims in the: South China Sea; Aegean Sea; Falklands Islands; and the Arctic. Against this background, this article analyses the effect of these challenges and developments on the causes of disputes over the hitherto established legal regime of islands under UNCLOS 1982.

BMDHS Kapsamında Adaların Hukuki Rejimi: Yeni Gelişmeler ve Zorluklar

Abstract

Adaların egemenliği ve deniz bölgelerinin sınırlandırılması hakkındaki ihtilaflar, sahildar ülkeler ile ada ülkeleri arasındaki alışılagelmiş deniz sınırı ihtilaflarının yerini almıştır. Bunun nedeni özellikle BMDHS 1982'den bu yana meydana gelen yeni gelişmeler ve zorluklardır. Bu gelişmelerin nedenleri denizcilik milliyetçiliğinin yeniden canlanması, keyfiyetle tayin edilmiş sömürge sınırlarının devamı; deniz doğal kaynakları için mücadele; adalardan yenilenebilir enerji kaynakları elde etme mücadelesi; mavi ekonominin ortaya çıkışı; küresel ısınmanın ada devletleri üzerindeki etkisi ve ulusal savunma ve güvenlik endişelerini kapsar. İhtilaflı alanlar arasında öne çıkan çekişmeli hak iddiaları Güney Çin Denizi, Ege Denizi, Falkland Adaları ve Arktik'tedir. Bu temele dayanarak, bu çalışma, BMDHS 1982 kapsamında adaların şimdiye dek kurulmuş hukuki rejimi hakkındaki itilafların üzerindeki bu zorluklar ve gelişmelerin etkilerini inceler.
