                            <p>The Ombudsman is an impartial and independent institution, which contributes to the dominance of good governance principles and participatory democracy in the operations of the administrations, reduces the burden of the judiciary system, supervises the administrations, and makes recommendations. The Ombudsman, to which individuals apply against the actions and transactions of the administrations that may cause them victimization, guides the actions and transactions of the administrations and eliminates individual victimization by its decisions. There is no study in the literature that analyzes the Ombudsman&#039;s decisions using qualitative and quantitative analytic methods within the scope of good management principles. To fill this gap, a total of 724 Ombudsman decisions made between 2016-2022 within the scope of the public personnel regime in Türkiye were examined in terms of good governance principles using content analysis, which is a qualitative analysis method. Findings showed that 47% of Ombudsman applications are for the actions and transactions of the Ministry of Health, Ministry of National Education, and University Rectorates. According to the subject of the application, 67% of the applications were related to the appointment, assignment and staffing requests, and the payment of financial rights. The number of non-compliance with good management principles in 724 decisions examined was 922 and 43.6% belonged to the administrations of the Ministry of Health, University Rectorates and the Ministry of National Education. Pearson χ² (chi-square) test, a quantitative analysis method, was run to determine whether the compliance of the administrations with good governance principles is different. It was observed that there are significant differences in the level of compliance of the administrations with some good governance principles, including &#039;Showing the remedies against the decision, Compliance with the law, Courtesy, Transparency, Compliance with the rightful expectation, Protection of vested rights, and Right to information&#039;. It cannot be stated that the principles of good governance were fully addressed and examined in detail in the Ombudsman&#039;s reports. It is recommended that in the ombudsman&#039;s decisions, the incompatibilities be identified in the &#039;Assessment of Compliance with Law, Equity and Human Rights&#039; section in terms of good governance principles in the &#039;Evaluation of Good Governance Principles&#039; section.</p></trans-abstract>
                                                                                                                                    <abstract><p>Ombudsmanlık, idareler üzerinde denetleme yapan, tavsiyelerde bulunan bir kurum olmanın ötesinde idarelerin işlemlerinde iyi yönetim ilkeleri ve katılımcı demokrasinin hakim olmasına katkı sağlayan, yargı yükünü azaltan, tarafsız, bağımsız bir kurumdur. Bireylerin idarelerin mağduriyet doğuran eylem ve işlemlerine karşı başvurduğu Ombudsmanlık, verdiği kararlarla bireysel mağduriyetin giderilmesi yanında idarelerin eylem ve işlemlerine de rehberlik etmektedir. Ombudsmanlık kararlarının iyi yönetim ilkeleri kapsamında nitel ve nicel analiz yöntemleriyle analizini yapan çalışmaya literatürde rastlanmamıştır. Bu nedenle Türkiye’de kamu personeli rejimi kapsamındaki 2016-2022 yılları arası 724 Ombudsmanlık kararı iyi yönetim ilkeleri bakımından nitel analiz yöntemi olan içerik analizine tabii tutulmuştur. Ombudsmanlık başvurularının %47’si Sağlık Bakanlığı, Milli Eğitim Bakanlığı ve Üniversite Rektörlükleri eylem ve işlemlerine yöneliktir. Başvuru konusuna göre müracaatların %67’si atama, görevlendirme ve kadro talepleri ile mali hakların ödenmesine ilişkindir. İncelenen 724 kararda iyi yönetim ilkelerine uyumsuzluk sayısı 922&#039;dir ve %43,6’sı Sağlık Bakanlığı, Üniversite Rektörlükleri ile Milli Eğitim Bakanlığı idarelerine aittir. İdarelerin iyi yönetim ilkelerine uyumunun farklı olup olmadığını tespit etmek için nicel analiz yöntemlerinden pearson χ² (ki-kare) testi uygulanmıştır. İdarelerin, ‘karara karşı başvuru yollarının gösterilmesi, kanunlara uygunluk, nezaket, şeffaflık, haklı beklentiye uygunluk, kazanılmış hakların korunması, bilgi edinme hakkı’ iyi yönetim ilkelerine uyum düzeylerinde anlamlı farklılıklar olduğu tespit edilmiştir. Ombudsmanlık raporlarında iyi yönetim ilkelerinin tümüyle ele alındığı, ayrıntılı incelendiği söylenemez. Ombudsmanlık kararlarında ‘Hukuka, hakkaniyete ve insan haklarına uygunluk yönünden değerlendirme’ bölümünde tespit edilen uyumsuzlukların ‘İyi yönetim ilkeleri yönünden değerlendirme’ bölümünde de iyi yönetim ilkeleri açısından ele alınmasında yarar görülmektedir.</p></abstract>
