                                                                                                <abstract><p>Farklılıkları yönetmede ulus-devletlerin sıklıkla başvurduğu soykırım, etnik temizlik, asimilasyon gibi negatif yöntemlerin yarattığı tahribat ve çatışma döngüsü, alternatif politik çözüm önerilerini tartışmaya açmıştır. Bu bağlamda bir taraftan devletlerin toprak bütünlüğü korunmaya çalışılırken diğer taraftan etno-kültürel grupların tanınma taleplerine karşı demokratik çözüm önerileri geliştirilmiştir. Bu gelişmelere koşut bir şekilde klasik anayasacılık anlayışı da derinden etkilenmiş; kuvvetler ayrılığı, yargı bağımsızlığı, hukuk devleti, insan hakları, adil ve serbest seçimler gibi klasik liberal anayasal ilke ve kurumlara ek olarak yeni kurumsal düzenlemelerin gerekliliği ortaya çıkmıştır. Böylece farklılıkların kamusal/kurumsal olarak ifade edilmesine izin veren ve iktidarın tekelleşmesini önleyen “güç paylaşımı” modeli geliştirilmiştir. Bu makale, Türkiye’de etno-kültürel farklılıklar temelinde baş gösteren çatışmaların yönetilmesinde bir anayasal tasarım olarak ortaklıkçı güç paylaşımı sisteminin, alternatiflerine göre rasyonel çözüm üretebilme kapasitesini ortaya koymayı amaçlamaktadır. Çalışma kapsamında ortaklıkçı güç paylaşımı sisteminin öngörmüş olduğu mekanizmaların, bölünmüş/kutuplaşmış bir toplumsal yapıya sahip olan Türkiye’de, çatışmaların şiddetten arındırılarak pozitif barışa dönüştürülmesinde uygun bir reçete olup olmadığı incelenmiştir.</p></abstract>
                                                                                                                                                                                    <trans-abstract xml:lang="en">
                            <p>The cycle of destruction and conflict created by negative methods such as genocide, ethnic cleansing and assimilation, which nation-states frequently resort to in managing differences, has led to the discussion of alternative political solutions, and while trying to protect the territorial integrity of states on the one hand, democratic solutions have been developed against the recognition demands of ethno-cultural groups on the other. In parallel to these developments, classical constitutionalism has also been profoundly affected; the necessity of new institutional arrangements in addition to classical liberal constitutional principles and institutions such as separation of powers, independence of the judiciary, rule of law, human rights, fair and free elections has been opened to discussion. Thus, a new understanding has developed in the form of power-sharing that allows for the public/institutional expression of diversity and prevents the monopolization of power and authority. This article aims to reveal the capacity of the consociational power-sharing system as a constitutional design to produce rational solutions in the management of conflicts arising on the basis of ethno-cultural differences in Turkey. Within the scope of the study, it is examined whether the mechanisms envisaged by the consociational power-sharing system are a suitable recipe for transforming conflicts from violence to positive peace in Turkey, which has a divided/polarized social structure.</p></trans-abstract>
