REASONS FOR REVERSAL OF THE DECISION TO CONFIRM THE CONCORDATION

Abstract

Following the abolition of the institution of bankruptcy postponement, the only legal remedy for individuals and legal entities whose financial structures have been disrupted is the institution of composition. The 6th Civil Chamber of the Court of Cassation, authorized by the Court of Cassation's division of labor to review claims arising from composition, aims to contribute positively to the success of the composition process through its decisions. It aims to ensure that individuals and companies benefit from composition provisions, rather than bankruptcy, to avoid harm to themselves or their creditors with whom they have economic relations. It also plays a positive role in guiding individuals and institutions through various practices to prevent harm. This study provides some assessments regarding the issues cited as grounds for reversal in the decision to confirm composition and the bankruptcy decision in the event of a rejection of the confirmation decision.

KONKORDATONUN TASDİKİ KARARINDA BOZMA SEBEPLERİ

Abstract

İflas erteleme kurumunun kaldırılmasından sonra mali yapısı bozulan gerçek ve tüzel kişiler yönünden tek hukukî çare olarak konkordato kurumu bulunmaktadır. Yargıtay’ın konkordato kaynaklı talepleri incelemekle iş bölümü itibariyle yetkili kılınan Yargıtay 6. Hukuk Dairesi, konkordatonun başarılı olması, ülke ekonomisinin üretim ve istihdamına katkı sağlanması bakımından olabildiğince iflasa nazaran kişi ve şirketlerin konkordato hükümlerinden yararlanarak hem kendilerinin hem de ekonomik ilişkilerde bulundukları alacaklılarının zarar görmemesi bakımından, konkordato sürecinin başarıya ulaşmasına verdiği kararlarla olumlu katkı sağlama amacını taşımakta, farklı uygulamalarla kişi ve kurumların zarar görmemesi için olumlu anlamda yol gösterici bir rol üstlenmektedir. Bu çalışmada konkordatonun tasdiki kararında bozma sebebi yapılan hususlar ve konkordatonun reddi durumunda iflâs kararına ilişkin bazı değerlendirmelerde bulunulmaktadır.
