BANKALARIN KONKORDATO İSTEMCİSİNİN HESAPLARINA BLOKE KOYMASI SORUNU ÖZELİNDE KONKORDATODA ALACAKLILAR ARASINDA EŞİTLİK İLKESİ

Abstract

Konkordato hukukunda uygulamada belki de en çok karşılaşılan sorunlardan birisi de şüphesiz bankaların konkordato istemcisinden olan alacaklarına ilişkin hukuki sorunlar ve uygulamalar oluşturmaktadır. Alacaklı bankaların verilen geçici mühlet kararından sonra borçlu ile aralarındaki kredi sözleşmesi , cari hesap ve çek kullanımı ile ilgili diğer sözleşmelerinden kaynaklanan alacaklarını , borçlu şirketin hesabına gelen alacaklardan mahsup ettiği bazen bu hesaplara bloke koyduğu görülmektedir.
Bankalarca konkordato istemcilerin hesaplarına ilişkin yapılan takas , mahsup ve bloke koyma işlemlerine karşı davacı tarafça yapılan taleplere ilişkin Mahkemelerce bu işlemlerin engellenmesine yönelik ihtiyati tedbir kararı verilmekte ve gerekçe olarak alacaklılar arasında eşitlik ilkesi belirtilmektedir.Bununla birlikte bankalara konkordato istemcisi tarafından verilen çeklerin de aynı şekilde alacaklılar arası eşitlik ilkesi gözetilerek iadesine yönelik kararlar verildiği görülmektedir.

THE PRINCIPLE OF EQUALITY AMONG CREDITORS IN CONCORDATO, PARTICULARLY REGARDING THE PROBLEM OF BANKS' BLOCKAGES ON THE ACCOUNTS OF THE COMPOSITION CLIENT

Abstract

Perhaps one of the most frequently encountered problems in the practice of composition law is the legal issues and practices related to banks' receivables from composition clients. Following the temporary respite decision, creditor banks are observed offsetting their receivables arising from loan agreements, current accounts, and other agreements related to the use of checks with the debtor against the receivables received by the debtor company, and sometimes placing blocks on these accounts. In response to the claims made by the plaintiff against the clearing, offsetting and blocking transactions made by the banks regarding the accounts of the composition clients, the Courts have issued interim injunctions to prevent these transactions and the principle of equality among creditors is stated as the justification. Furthermore, it is observed that decisions are made to return the cheques given to the banks by the composition clients, similarly taking into account the principle of equality among creditors.
