Bu çalışma, birisi temel diğeri tali olmak üzere iki meseleyi incelemek üzere kaleme alınmıştır. Temel konu, ‘örfe dayalı nass meselesi’ hakkında Ebu Yusuf’a atfedileniçtihadın tespitidir. Bu içtihat son dönemlerde İslam’ın sosyal hayata ilişkin hükümlerinde örfün tek ve mutlak kriter olarak kabul edilebileceği şeklindeki yorumlara mesnet yapılmıştır. İncelenmesi amaçlanan ikinci mesele, işte bu iddiaya Ebu Yusuf’un zikri geçenmeseledeki içtihadının dayanak yapılıp yapılamayacağı konusudur.
