Ulusal İnsan Hakları Kurumları Küresel İttifakı (GANHRI) bünyesinde faaliyetlerini yürüten Akreditasyon Alt Komitesi (SCA), ulusal insan hakları kurumlarının akreditasyonu sürecinde lokomotif konumundadır. Yılda iki kez hazırlamış olduğu raporlarla UİHK’lara yönelik yol gösterici tavsiyelerde bulunan SCA, toplam 20 maddeden oluşan Genel Gözlemlere atıf yaparak bu tavsiyelerini sunmaktadır. Raporlar incelendiğinde Genel Gözlem maddelerinden bazılarının daha öne çıktığı görülmektedir. Her ülkenin kendi koşullarının farklı olmasını gözetmekle birlikte SCA, Genel Gözlem maddelerine yaptığı atıflar ve sunduğu tavsiyelerle evrensel nitelikte kabul ettiği ilkeleri hayata geçirmeye çalışmaktadır. SCA, insan haklarını koruyup geliştirmek ve uluslararası hukukta belli bir yeknesaklığı hakim kılmak amacıyla Paris Prensipleri’ni somutlaştırmaktadır. Bu bağlamda çalışma kapsamında; SCA’nın 2022-2023 tarihlerinde hazırlamış olduğu raporlar incelenerek, Paris Prensipleri’nin nasıl somutlaştırıldığı, akreditasyon sürecinde hangi temel sorunlarla daha çok karşılaşıldığı ve bunlar karşısında UİHK’ların nasıl hareket etmesinin beklendiği tespit edilmeye çalışılmıştır. Böylece Paris Prensipleri’nin varlık sebepleri olarak ortaya konan; bağımsızlık, etkililik (efektiflik) ve çoğulculuğun UİHK’lara hakim kılınmasına ve UİHK’ların akreditasyon süreçlerinde “A” statüsünü nasıl kazanıp muhafaza edebileceğinin tespitine katkı sunulması hedeflenmiştir.
The Sub-Committee on Accreditation (SCA),which carries out its activities within the Global Alliance of National Human Rights Institutions (GANHRI), is the locomotive in the accreditation process of national human rights institutions. SCA, which makes guiding recommendations to NHRIs through the reports it prepares twice a year, offers these recommendations by referring to the General Observations, which consist of a total of 20 articles. When the reports are examined, it is seen that some of the General Observation items stand out. While considering that each country's conditions are different, SCA tries to implement the principles it accepts as universal through its references to the General Observation articles and the recommendations it offers. SCA embodies the Paris Principles with the aim of protecting and promoting human rights and ensuring a certain uniformity in international law. In this context, within the scope of this study; by examining the reports prepared by SCA in 2022-2023, it was tried to determine how the Paris Principles were embodied, which basic problems were most encountered in the accreditation process, and how NHRIs were expected to act in the face of these. Thus, it is aimed to contribute to ensuring independence, effectiveness and pluralism which are the reasons for the existence of the Paris Principles prevail in NHRIs and to determine how NHRIs can gain and maintain the "A" status in accreditation processes.
