Bilişim teknolojilerinin gündelik yaşam, devlet yönetimi, özel teşebbüslerin iş yapma pratikleri gibi pek çok alanda muazzam olanaklar sunduğu açıktır. Ancak bazı “yan etkileri”nin, başta insan onuru olmak üzere, demokratik toplumsal yapının temel değerlerine yöneldiği göz ardı edilmemelidir. Federal Almanya Anayasa Mahkemesi de 1983 yılında verdiği ve bilgisayar teknolojisi ile kişisel bilgilerin işlenmesinin yaratabileceği sorunları değerlendirdiği kararında, temelini insan onuru ve kişilik hakkında bulan “bilgilerin geleceğini belirleme hakkı”nın önemini, gerekliliğini ve sınırlarını ortaya koymuştur. Bilişim teknolojilerinin ilk gelişim aşamasında verilmiş bu karar, Türkiye’de bugün karşılaştığımız bazı sorunların çözümünde yol gösterici olabilir. Bu çalışma kapsamında Türkiye’de konuya ilişkin düzenlemeler, Türkiye İstatistik Kanununun ilgili hükümleri özelinde karşılaştırmalı bir yaklaşımla değerlendirilmiştir

In 1983, German Constitutional Court had given a significant ruling on Population Census Law. In the ruling, which it judged the problems of personal-data processing by means of the developing computer technology; it put forth the importance, the borders, and the need for ¨informational self-determination¨, which was grounded on human dignity and personal right. Court's assessment is vital for minimizing the side effects of the development of technology. On the other hand, the ruling, which was made in the beginning of the development of information technologies, is a beacon for most of the problems, that we face in Turkey in the present. In this paper onlegislation in Turkey, particularly Turkey Statistics Law's articles have been discussed
