Günümüzde mülteci hukukunun temelini Türkiye’nin de taraf olduğu 1951 tarihli Mültecilerin Hukuki Durumuna Dair Konvansiyon oluşturmaktadır. 1951 tarihli Konvansiyonun 1. maddesinde “mülteci” tanımlanmış ve tanımda ”1 Ocak 1951’den önce cereyan eden olaylar…” şeklinde tarihe ilişkin sınırlamaya yer verilmiştir. Konvansiyonun 1/B-1(a). maddesinde de coğrafi mekân bakımından akit devletlere sınırlama getirme hakkı tanınmış ve “mülteci” statüsünün yalnızca 1 Ocak 1951'den önce “Avrupa'da meydana gelen olaylar" ile sınırlanabileceği belirtilmiştir. Cenevre Konvansiyonu’nun zaman ve coğrafi mekân sınırlaması ile kabul edilmesi birçok kişinin mağduriyetine yol açmıştır. Zira “mülteci” statüsünü belirleyen kriter ve olaylar 1 Ocak 1951’den sonraki tarihlerde de meydana gelmeye devam etmiştir. Bu acı gerçeğin dikkate alınması sonucunda, 1967 tarihli Mültecilerin Hukuki Statüsüne İlişkin Protokol imzalanmış ve tarihe ilişkin sınırlama kaldırılmıştır. Türkiye, 1951 tarihli Cenevre Konvansiyonu’na taraf olurken, akit devletlere tanınan sınırlama koyma hakkını kullanmış ve mülteci statüsünün tanınması bakımından tarihe ilişkin sınırlamanın yanı sıra, coğrafi sınırlamayı da uygulamaya koymuştur. Ancak 1968 yılında Türkiye’nin de Protokolü imzalamasının ardından tarihe ilişkin sınırlama önemini kaybettiyse de, coğrafi sınırlamanın uygulanmasına günümüzde de devam edilmektedir. Fakat bu durum Türk mülteci hukukunda uygulanan coğrafi sınırlamanın kaldırılmasına ilişkin tartışmaları da beraberinde getirmiş ve hatta Avrupa İnsan Hakları Mahkemesi’nin (AİHM) kararına da konu olmuştur. Konunun güncelliği nedeniyle çalışmamızda, coğrafi sınırlamanın uygulanması ve bu uygulamanın kaldırılması sorunu irdelenecektir.
Nowadays, the 1951 Convention Relating to the Status of Refugees, to which Turkey is also a party, constitutes the basis of refugee law. In the 1st article of the 1951 Convention, “refugee” is defined and the definition includes a limitation on history as “events that took place before 1 January 1951…” In Article 1/B-1(a) of the Convention, the contracting states are granted the right to impose restrictions in terms of geographical space, and it is stated that the "refugee" status can only be limited to "events occurring in Europe" before 1 January 1951. The adoption of the Geneva Convention with the limitation of time and geographical space led to the grievances of many people because the criteria and events determining the “refugee” status also continued to occur after 1 January 1951. As a result of this harsh reality being taken into account, the 1967 Protocol Relating to the Status of Refugees was signed, and the temporal limitation was removed. When Turkey became a party to the 1951 Geneva Convention, it used its right to impose restrictions granted to the contracting states and implemented the geographical limitation along with the temporal limitation in terms of the recognition of refugee status. However, although the temporal limitation lost its importance after Turkey signed the Protocol in 1968, the geographical limitation continues to be applied today. However, this situation has brought about discussions on the removing of the geographical limitation applied in Turkish refugee law and has even become the subject of a decision of the European Court of Human Rights (ECHR). Due to the subject’s topicality, the application of the geographical limitation and the issue of the removing of this application will be addressed in our study.
