“Evlilik birliği sona ermiş olmasına rağmen bir kişinin eski eşine süresiz mali katkıda bulunmasını zorunlu kılan sebep nedir?” sorusu yoksulluk nafakasına dair tartışmaların kilometre taşıdır. Bu çalışma aynı soruyu şöyle sormaktadır: “Evlilik birliği sona ermiş olmasına rağmen bir kişiyi eski eşinin mali katkısına süresiz muhtaç kılan sebep nedir?” Makalenin amacı yoksulluk nafakasını kadının insan hakları perspektifiyle ele almaktır. Çünkü Türk yoksulluk nafakası kararları doğrultusunda yoksulluğun cinsiyetinin kadın olduğu görülmektedir. Bu nedenle çalışmada öncelikle kadın yoksulluğunun kök nedenleri araştırılmış akabinde bu nedenlerin kadının insan haklarına ve yoksulluk nafakasına etkisi ele alınmıştır. Zira toplumsal cinsiyet rol dağılımının hane içi eşitsizlik olarak tebarüz etmesi, bir yandan yoksulluk nafakası ile bu eşitsizliğin telafisini gerektirirken diğer yandan da sosyal devlet ilkesi gereği devletin sorumluluğunu doğurmaktadır. Çalışmada resmi istatistik verilerinden ve saha araştırma bulgularından yararlanılmış, makale ampirik ve teorik bulgulara dayandırılarak kaleme alınmıştır. Ortaya çıkan bulgular ışığında yoksulluk nafakasına süre ile sınırlı olmaksızın hükmedilmesinin gerekçesi ve işlevi açıklığa kavuşturulmuştur. Çalışma yoksulluk nafakasına ilişkin sunulmuş değişiklik önerilerinin değerlendirilmesiyle sonlanmıştır.
"What is the reason why a person must make a financial contribution to his/her ex-spouse even though the marriage has ended?" is a milestone in the debate over alimony. This study asks the same question as follows: "What is the reason why a person needs the financial contribution of his/her ex-spouse even though the marriage has ended?" The article aims to deal with alimony from the perspective of women's human rights. Because, in line with the Turkish Court’s alimony decisions, it has been seen that the sex of poverty is female. In this context, firstly the root causes of women's poverty were investigated and then the effects of these reasons on women's human rights and alimony were discussed. The fact that gender role distribution is manifested as inequality intra-household, requires compensation for this inequality with alimony on the one hand and it creates the responsibility of the state following the social state principle on the other hand. In this process, field research data were used and the article was written based on empirical and theoretical findings. In line with these findings, the reason and function of indefinite alimony have been clarified. The study ended with the evaluation of the proposed amendments regarding indefinite alimony.
