                            <p>Almanya’da 06.07.2017 tarihinde “Ücrette Şeffaflık Kanunu (Entgelttransparenzgesetz)” yürürlüğe girmiştir. Bu kanunun amacı, aynı veya aynı değerdeki işte çalışan kadın ve erkekler arasında ücret eşitliğinin sağlanmasıdır. Yeni Kanuna göre, eğer işyerinde 200’den fazla çalışan varsa, çalışanlar ücret yapıları ve karşılaştırma yapılan gruptaki çalışanların ücretleri hakkında bilgi edinme hakkını kullanabileceklerdir. 500’den fazla çalışanı olan işyerlerinin işverenleri ise kadın ve erkek çalışanlar arasında eşitliğin sağlanması çabalarına ilişkin düzenli rapor vermekle yükümlü tutulmuşlardır. Öte yandan işyeri kurulu (Betriebsrat) da çalışanları cinsiyete dayanan nedenlerle yapılan ücret ayrımcılığından korumak için gerekli önlemleri almakla yükümlüdür. Fakat Kanunun, kadın ve erkek çalışanlar arasında ücrete dayalı cinsiyet eşitliğini gerçekten geliştirip geliştiremeyeceği henüz belirsizdir. Tüm olumsuz eleştirilere rağmen, söz konusu kanunun ilerleyen zamanda, ücrette kadın ve erkek eşitliğinin sağlanması amacına ulaşmada katkı sağlayabileceği de ifade edilmektedir. Bu çalışmada, kanunun kapsamı, çalışanın ücret şartları ve usulü hakkında bireysel bilgi edinme hakkı ve işveren ile işyeri kurulunun hak ve yükümlülüklerinin incelenmesi amaçlanmaktadır. Bu amaç doğrultusunda Alman doktrininde ileri sürülen değerlendirmeler ve öneriler incelenmiştir.&amp;nbsp;</p></trans-abstract>
                                                                                                                                    <abstract><p>In Germany, “Act to Promote Transparency of Pay Structures (Entgelttransparenzgesetz)” entered into force on 06.07.2017. The purpose of this Act is an achievement of the pay equity between men and women, who perform the same work or work of equal value. According to this new Act individual employees are able to claim for information about pay structures and the remuneration of other employees within one comparison group, if the company regularly employs more than 200 employees. Companies with more than 500 employees is obligated to generate regular reports on their efforts to promote equality between men and women. On the other hand, works council (Betriebsrat) are obliged to take the necessary measures to protect workers from discrimination of pay on grounds of sex. But it is uncertain whether the Act will improve gender equality between men and women. Despite all the negative discourses, it is also stated that the Act may contribute to reaching the goal of ensuring equality between men and women after a while. In this study aimed to be examined of the scope of the Act, individual information right on the criteria and procedures for the remuneration of the employees, obligations and rights of the employers and works council. For this purpose, assessments and suggestions in the German doctrine were examined.&amp;nbsp;</p></abstract>
