                            <p>Habeas data is a contitutional complaint which emerged in the end of 1980s in Latin American Countries and is accepted as one of the most important data protection approaches in the world. Right to habeas data enables people to request from courts to protect their personal data by submitting a petition. The scope of the right to habeas data may vary from country to country in terms of the rights that the data subjects may demand and the nature of the data recording system (public/private) to which the complaint is directed. In this study, the place of  right to habeas data in data protection subject in the World, history, purpose, scope of right to habeas data, differences of its practice in the Latin American countries, its relation with data protection, disadvantages, as well as new developments related to data protection in Latin America countries  will be examined. In order to embody habeas data concept, its practice in Argentina also will be analyzed.</p></trans-abstract>
                                                                                                                                    <abstract><p>Habeas data, 1980’lerin sonunda Latin Amerika ülkelerinde ortaya çıkan bir anayasa şikâyetidir ve kişisel verilerin korunması konusunda dünyadaki önemli yaklaşımlardan birisi olarak kabul edilmektedir. Habeas data, kişilerin mahkemelere verecekleri bir şikâyet dilekçesiyle kişisel verilerinin korunmasını talep etmelerine imkân tanımaktadır. Habeas datanın kapsamı, ilgili kişilerin talep edebileceği haklar ve şikâyetin yöneltileceği veri kayıt sisteminin niteliği (kamu/özel) açısından ülkeden ülkeye değişebilmektedir.  Çalışmada kavramın dünyada kişisel verilerin korunması konusundaki yeri, tarihçesi, amacı, kapsamı ve Latin Amerika ülkelerinde kapsamına yönelik farklılıklar, kişisel verilerin korunmasıyla ilişkisi ve dezavantajları incelenecektir. Latin Amerika ülkelerinde kavram ve kişisel verilerin korunması konusundaki son gelişmelere yer verildikten sonra, kavramın uygulanmasına yönelik açıklamaları somutlaştırmak adına, Arjantin uygulaması ele alınacaktır.</p></abstract>
