The Evaluation of Impure Things in the Context of Possibility of Utilizing from the Fiqh Perspective

Abstract

The impure materials are encountered more often and more in the field in the daily life than in the past. This situation has made it necessary to rethink the rule of taking advantage of things that are impure. As a matter of fact, by this motive individual and collective scale scientific studies have been carried out in recent years under the titles of halal food, halal clothing, halal cosmetics and metamorphism. In order to obtain a correct result in such studies, it is important firstly to examine the opportunity to benefit from impure things in a fiqh way. The data to be provided in the context of the studies that to be carried out in this direction will contribute to the establishment of the basic principles which used in the solution of contemporary fiqh problems related to benefit from the unclean things. In this study which done for this purpose is discussed the possibility of using impure things by evaluating the texts and scribes (fuqaha) approaches. In the first part of the article, things that have the nature of impure have been assessed in terms of whether or not the betting has passed and the prohibition about it is absolute. In the second part, it was tried to determine the effect of the structural change on the rule of impurity.

Necis Şeylerin Faydalanılabilirlik Bağlamında Fıkhî Açıdan Değerlendirilmesi

Abstract

Necis maddeler geçmişe nispetle daha çok alanda ve daha çok miktarda günlük hayata dâhil edilmiş bulunmaktadır. Bu durum, necis niteliğini taşıyan şeylerden faydalanmanın hükmünü yeniden düşünmeyi zorunlu hale getirmiştir. Nitekim bu saikle son yıllarda helâl gıda, helâl giyim, helâl kozmetik ve istihâle gibi başlıklar altında bireysel ve kolektif çapta bilimsel çalışmalar gerçekleştirilmektedir. Bu tür çalışmalarda isabetli bir sonuç elde edilebilmesi için öncelikle necis şeylerin faydalanılabilirliğinin fıkhî açıdan etüt edilmesi önem arz etmektedir. Bu yönde yapılacak araştırmalar neticesinde ulaşılacak veri, necis şeylerden faydalanmaya ilişkin güncel fıkhî problemlerin çözümünde kullanılacak temel ilkelerin oluşturulmasına katkı sağlayacaktır. Bu amaçla yapılan bu araştırmada, nasslar ve fukahânın yaklaşımları değerlendirilerek necis şeylerden faydalanma imkânı tartışılmaktadır. Makalenin birinci kısmında necis niteliğini taşıyan maddeler, nasslarda bahsinin geçip geçmemesi ve hakkındaki tahrîmin mutlak olup olmaması açısından değerlendirmeye tabi tutulmaktadır. İkinci kısmında ise yapısal değişime uğramış olmanın, necâsetin hükmü üzerindeki etkisi tespit edilmeye çalışılmaktadır.
