The basic introduction of the taqdiri durumphenomenon was intended in this article. Theoretical research on the phenomenonwas conducted by different schools with the exception of the Hanafi school. Byinvestigating the definitions, explanations, and examples addressed in theprevious research, the Hanafi approach on the phenomenon was intended to beidentified. Throughout the paper, Bedâi'u's sanâi had an importantimpact on identifying the nature of taqdiri durum. The reason is because thephenomenon was used intensively and effectively in this book. Thus, Kasani'sapproach was at the center. In this context, the phenomenon can be described asthe following using the term “taqdiri durum:” Resolving the uncertainitiesconcerning the current issues related to the parties of a provision ofshar’iyya, and treating a real situation that is the topic of a provision in adifferent way from its original use due to legitimate reasons.
Bu makalede takdirî durumun genel tanıtımıhedeflenmiştir. Olguya ilişkin teorik çalışmalar Hanefî ekolü dışındayapılmıştır. Bu çalışmalardaki tanımlar, kullanılan tabirler ve örneklerincelenerek olguya yönelik genel Hanefî yaklaşımı tespit edilmeyeçalışılmıştır. Takdirî durumun mahiyetine ilişkin tespitlerimizde Bedâi‛u’s-sanâi‛ninönemli bir etkisi bulunur. Zira takdirî durum bu eserde gayet yoğun ve etkinkullanılır. Bu sebeple Kâsânî’nin yaklaşımı merkeze alınmıştır. Bu kapsamdaolgu “takdirî durum” tabiri kullanılarak şöyle tanımlanabilir: Şer’î bir hükmünmüteallakı olan mevcutlara dair belirsizliklerin giderilmesi ve hükme konu olanşeye ilişkin gerçekteki durumun meşru gerekçeler uyarınca bulunduğundan farklıbir konumda değerlendirilmesidir.
