Mısır’ın 20. yüzyıldaki kanunlaştırma tecrübesi, Arap dünyasında hukuk alanında öncü bir model teşkil ederek Irak, Suriye, Libya ve Körfez ülkeleri gibi birçok devlette yasa yapma süreçlerini derinden etkilemiştir. Mecelle’nin kaldırılması ve Avrupa menşeli kanunların kabulü sonrasında, Mısır hukuk sisteminin incelenmesi modern Türkiye açısından da ayrı bir önem kazanmıştır. Yüzyıl boyunca değişen rejimler, Mısır hukuk düzeninde ideolojik çeşitlilik yaratmış; liberal, ulusalcı-sosyalist ve İslamî yönelimli kanunlar aynı dönemde varlık göstermiştir. Bu durum, Mısır’daki kanunlaştırma hareketlerini karmaşık hale getirmiştir. El-Ezher, Batılılaşma karşısında direnişin merkezinde yer almış ve bu çabalar, modern dönemde kurulan ilk küresel fıkıh konseyi olan Mecmeü’l-Buhûsi’l-İslâmiyye’nin kuruluşuyla kurumsallaşmıştır. Akademi, İslam hukukunun kanunlaştırılmasına yönelik çalışmalarda temel bir referans noktası olmuş ve 1983’te Halk Meclisi’nin hazırladığı İslam hukuku temelli yasa taslağına kaynaklık etmiştir. Ancak bu girişimler, hukuk eğitiminin ikili yapısı, Fransız hukukunu benimseyen elitler ve siyasi irade eksikliği nedeniyle uygulamaya aktarılamamıştır. Neticede, İslam hukukunun kanunlaştırılması fikri, teorik ve parça parça yaklaşımlar düzeyinde kalmıştır. Bu makale, söz konusu süreci hukuk sosyolojisi perspektifinden ele alarak Mısır örneğinde teorik tasarılarla pratik uygulamalar arasındaki uyumsuzluğu açıklamayı amaçlar; bulgular, kurumsal ve epistemik engeller nedeniyle kanunlaştırma çabalarının bütüncül bir modele dönüşemediğini göstermektedir. Çalışma, literatürde tarihî/karşılaştırmalı çerçeveye sıkışan tartışmaları çok katmanlı bir sosyo-hukuki analizle genişleterek önemli bir boşluğu doldurmaktadır.
Egypt’s codification experience in the twentieth century constituted a pioneering model in the Arab world, profoundly influencing the legislative processes of countries such as Iraq, Syria, Libya, and several Gulf states. Following the abolition of the Mecelle and the adoption of European-based legal codes, the study of the Egyptian legal system gained particular significance for modern Turkey. Throughout the century, successive regimes in Egypt produced considerable ideological diversity within the legal order, as liberal, nationalist-socialist, and Islamic-oriented laws coexisted during the same periods. This diversity rendered the codification movements increasingly complex. El-Ezher stood at the forefront of resistance to Westernization, and these efforts were institutionalized with the establishment of the Islamic Research council, the first global fiqh council of the modern era. The Academy became a major reference point for studies on the codification of Islamic law and served as a foundational source for the comprehensive draft law based on Islamic jurisprudence prepared by the Egyptian People’s Assembly in 1983. However, these initiatives could not be effectively implemented due to the dual structure of legal education, the dominance of elites trained in French law, and the lack of political will. Consequently, the idea of codifying Islamic law remained confined to theoretical and fragmented approaches. This article analyzes the process from a socio-legal perspective, seeking to explain the gap between theoretical designs and practical applications in the Egyptian case. The findings reveal that institutional and epistemic obstacles prevented codification efforts from evolving into a coherent model. By expanding discussions often limited to historical or comparative frameworks, this study fills a significant gap in the existing literature through a multilayered socio-legal analysis.
