SOSYAL VE ETİK YÖNLERİYLE TÜRKİYE’DE BABALIK TESTLERİ

Abstract

Nesep tayini ya da soy bağı belirlenmesi adli bilimlerde sıklıkla başvurulan uygulama alanlarından biridir. Geçmişte fiziksel özelliklerin benzerliklerinden ve kan grubu analizlerinden faydalanılarak yapılan yorumların yerini günümüzde, net sonuçlar (%99,99 olasılıkla) veren genetik analizler almıştır. Teknolojik değişikliklerle beraber aile bağları açısından önemli sonuçları olan babalık testleri ile ilgili etik kaygılar da her geçen gün şekil değiştirmektedir. Babalık testlerinde tüm tarafların onay vermesi gerekliliği tartışmaları yerini, bir kişiye ait biyolojik bir materyalin ondan habersiz laboratuvara gönderilip, test edilmesi ile ilgili kaygılara bırakmıştır. Ticari firmalar tarafından gerçekleştirilen testlerin sonuçları, kendilerine ulaşan müşterilere herhangi bir genetik danışmanlık verilmeksizin teslim edilmekte ve toplumsal olarak önemli aile yapısının bu şekilde nasıl zarar görebileceği de düşünülmemektedir. Tüm biyoteknolojik uygulamalarda olduğu gibi, babalık testleri için de etik ihlaller iyice tartışılmalı ve ailelerin – özellikle de çocukların- duygusal, finansal ve fiziksel olarak zarar görmemesi için gerekli önlemler alınmalıdır.

SOCIAL AND ETHICAL ASPECTS OF PATERNITY TESTING IN TURKEY

Abstract

Paternity testing is one of the most frequent applications in forensic sciences. In the past, interpretations was made by using similarities of physical characteristics and blood groups. These old school methods have been replaced by genetic analyzes that give clear results (99.99% probability). Along with technological changes, ethical concerns about paternity tests, which have important consequences for family ties, are changing every day. Discussions about the necessity of consent of all parties in paternity tests have been replaced by concerns about sending a biological material belonging to a person to a laboratory without his knowledge. The results of the tests carried out by commercial companies are delivered to the customers who reach them without any genetic counseling, and it is not considered how the socially important family structure can be damaged in this way. As in all biotechnological applications, ethical violations for paternity tests should be discussed thoroughly and necessary precautions should be taken to prevent emotional, financial and physical harm to families and especially children.
