ASURCA ve BABİLCE METİNLERDE YEMİN

Abstract

Bu makalede Asur
ve Babil’de yemin uygulamasının sosyal, ekonomik, hukuki ve siyasi hayat içerisindeki
yeri ve önemi ele alınmaktadır. Bu amaçla hem resmi nitelikteki kraliyet
yazıtları ve hukuki kayıtlar hem de şahıslara ait hukuki ve ekonomik
nitelikteki belgeler incelenmiştir. Asur ve Babil’de yemin uygulanması toplum
hayatı içerisinde sorunların çözümünde ve gerçeğin ortaya konulmasında önemli
bir işlevi yerine getirmiş, ayrıca sözleşme ve anlaşmalarda taahhüt edici bir
amaca hizmet etmiştir. İncelediğimiz belgeler, yemin etme eyleminin dinsel bir
nitelik taşıdığını ve eylemin tapınakta, mahkemede ve kutsal mekânlarda
tanrıların huzurunda gerçekleştirildiğini göstermektedir. Asur ve Babil’de yalan
yere yemin edenlerin ve ettikleri yemini tutmayanların ağır cezalarla
yüzleşmeleri, yeminin bağlayıcı bir özelliği olduğunu ortaya koymaktadır.
