                            <p>Carl Schmitt, one of the most controversial figures of the twentieth century -an era shaped by crises and wars moves beyond an understanding of legitimacy reduced solely to legality by focusing on the constitutive sources that make legality itself possible. Schmitt’s nomothetic approach, developed particularly around the concept of nomos, continues to offer a fundamental framework for contemporary debates in legal and political theory, extending beyond the boundaries of his own historical moment.This article aims to analyze the transforming political, legal, and economic dynamics of the present by placing at its center the systematic body of thought Schmitt developed through the concept of nomos. In conducting this analysis, the study adopts a methodological premise that social processes cannot be confined to rigid mathematical formulations; rather, each historical period presents a distinctive context shaped by its own internal contradictions and dynamics.Accordingly, the article first examines the theoretical foundations of nomos and its key historical moments of rupture. It then evaluates contemporary perspectives in the literature on the impact of nomos on modern practices of sovereignty, with particular reference to the cases of Israel, China, and the United States. In the final section, through the lens of David Harvey’s concept of “time–space compression,” the article discusses how digitalization and data-driven centers of power are transforming the classical understanding of nomos. Ultimately, the study seeks to address whether the world stands at the threshold of a new order or is undergoing a transitional phase in which the existing nomos assumes new forms.</p></trans-abstract>
                                                                                                                                    <abstract><p>Krizler ve savaşlarla şekillenen 20. yüzyılın en tartışmalı figürlerinden biri olan Alman hukukçu Carl Schmitt, meşruiyeti salt yasallığa indirgeyen anlayışın ötesine geçerek, bu yasallığı mümkün kılan kurucu kaynaklara odaklanmıştır. Schmitt’in özellikle &#039;nomos&#039; kavramı ekseninde geliştirdiği nomotetik yaklaşım, kendi çağını aşarak günümüzün hukuk ve siyaset teorileri için temel bir tartışma zemini sunmaya devam etmektedir.Bu makale, Schmitt’in ‘nomos’ kavramı üzerinden şekillendirdiği düşünce sistematiğini merkezine alarak, günümüzün dönüşen siyasi, hukuki ve ekonomik dinamiklerini analiz etmeyi amaçlamaktadır. Ancak bu analiz yürütülürken, toplumsal süreçlerin keskin bir matematiksel formüle sığdırılamayacağı; her dönemin kendi içsel çelişkileri ve dinamikleriyle özgün bir bağlam sunduğu da metodolojik bir esas olarak kabul edilmiştir.Bu doğrultuda makale kapsamında ilk olarak nomosun teorik temelleri ve tarihsel kırılma noktaları ele alınmakta; ardından literatürdeki güncel yaklaşımlar ışığında İsrail, Çin ve ABD örnekleri üzerinden nomosun modern egemenlik pratikleri üzerindeki etkisine dair görüşler değerlendirilmektedir. Son bölümde ise David Harvey’in &quot;zaman-mekân sıkışması&quot; kavramı perspektifiyle, dijitalleşme ve veri temelli yeni güç odaklarının klasik nomos anlayışını nasıl dönüştürdüğü tartışılmaktadır. Makale, dünyanın yeni bir düzenin eşiğinde mi yoksa mevcut nomosun farklı şekillere büründüğü bir geçiş sürecinde mi olduğu sorusuna yanıt aramaktadır.</p></abstract>
