Anayasal iktisat, siyasi iktidarın anayasaya konacak ekonomik hükümlerle sınırlandırılması gerekliliğini ifade eder. Bunun teorik temellerini ise neoliberal söylemin bir varyantı olan genel olarak kamu tercihi teorisi ve onun varsayımları oluşturmaktadır. “Metodolojik bireycilik”, “bireysel rasyonellik” “maximand (homo economicus)” ve “politik mübadele” ilkeleri anılan teorinin varsayımları olarak durmaktadır. Öncelikle anayasal iktisadın beslendiği kanallar olduğundan bu varsayımların içeriği incelenmiştir. Fakat anılan inceleme kapitalizmin neoliberal dönemini başlatan eğilimlerden bağımsız gerçekleştirilmemiştir. Nitekim birikimi mümkün kılan koşulların yeniden yaratılması süreci devletin işlevleri ve hareket alanını da yeniden tanımlamıştır. Anılan bağlamda gerçekleştirilen tahlilin ardından anayasal iktisadın teorik öncüllerinde ifade edildiği gibi demokrasi ile bağlantısı olup olmadığı tartışılmıştır. Çalışmanın amacını da oluşturan bu hususa anayasal iktisadi rejime yöneltilen eleştirilerle sonuç kısmında yer verilmiştir.
Constitutional economics implies the necessity of restricting political power by economic provisions to be put into the constitution. The theoretical basis of this are the theory of public choice in general, which is a variant of neoliberal discourse, and its assumptions. The principles of "methodological individualism", "individual rationality" "maximand (homo economicus)" and "political exchange" stand as the assumptions of the aforementioned theory. First of all, the content of these assumptions has been examined since they are the channels through which constitutional economics is fed. However, the aforementioned analysis was not carried out independently of the trends that initiated the neoliberal era of capitalism. As a matter of fact, the process of recreating the conditions that make accumulation possible has redefined the functions and the field of action of the state. After the analysis carried out in the aforementioned context, it was discussed whether constitutional economics has a connection with democracy as expressed in its theoretical premises. This issue, which also constitutes the purpose of the study, is included in the conclusion part with the criticisms directed to the constitutional economic regime.
