AB  - Bu çalışmada, şeyhülislâm veya müftüler tarafından verilen fetvaların mahkemelerin ceza kararı kayıtlarında yer almasından hareketle Osmanlı ceza hukukundaki fetva kazâ ilişkisine değinilecektir. Ardından, Osmanlı ceza hukukundaki fetva kazâ ilişkisi mahkeme kayıtlarındaki örnekleri verilerek somutlaştırılacaktır. Çalışmanın, şer‘î-örfî hukuk ilişkisi, şer‘î hukuktan sapma ve keyfi uygulamalar gibi Osmanlı ceza hukuku etrafında tartışılan konulara uygulamadaki somut örnekleri sunması açısından katkı sağlayacağını umuyoruz

N2  - In this study, the reference of fatwa and judgment (kazâ) in the Ottoman Criminal Law will be discussed based on the fatwas given by shayk al-Islam or muftis included in the court records of criminal sentence. Later, the relationship of fatwa and judgment in Ottoman Criminal Law will be embodied by the sample cases picked from the court records. We hope that the study will make a contribution to the discussed issues over the Ottoman Criminal Law such as the relationship between Muslim Law (Shariah) and the Customary Law, stray from shariah law, and arbitrary enforcement
