AB  - Temel Haklar ve Hürriyetler ile ilgili bir tercüme ve derlemeyi sunuyoruz. Çalışma, Federal Almanya Anayasa Mahkemesi (FAM) ile, Yargıtay, Danıştay, Sayıştay ve Eyalet Yüksek Mahkemelerinin kararlarından derlenmiştir. Ancak ağırlıklı olarak Federal Anayasa Mahkemesinin kararları esas alınmış, bu kararlar ile bağlantılı ve ilgili olduğu derecede diğer anılan mahkemelerin karalarına da işaret edilmiştir. Dikkat edilirse görülür ki, bu yüksek organlar işaret edilen kararlarında, FAM’nin kararlarındaki ifadeleri aynen veya benzer şekilde kullanmışlardır.Türkçe’ye çevrilen kararlar, esas itibariyle temel hakların özü ve bu öze dokunulamayacağını ifade eden GG (Gurundgesetz für die Bundesrepublik Deutshland/ Federal Almanya Cumhuriyeti Anayasası) md.19 ile ilgilidir. Bu md. üzerinde çok şey yazılmıştır ve daha da yazılacaktır. Bu md., 1961 Anayasamıza da alınmıştı.1982 Anayasasında bu md.ye yer verilmemiş,.ama benzer unsurları ifade eden md.ler (md. 12-15) yer almıştır. O bakımdan Türk Anayasa Hukuku bakımından halen de önemli ve ilgilidir.

N2  - We present a translation and compilation of Fundamental Rights and Freedoms. The study was compiled from the decisions of the Federal Constitutional Court of Germany (FAM), the Supreme Court of Appeals, the Council of State, the Court of Accounts and the State Supreme Courts. However, the decisions of the Federal Constitutional Court were mainly taken as basis, and the decisions of other mentioned courts were also pointed out to the extent that they were related and related to these decisions. If you pay attention, it can be seen that these higher bodies used the same or similar expressions in the FAM's decisions in their decisions.The decisions translated into Turkish are essentially related to the essence of fundamental rights and Article 19 of the GG (Gurundgesetz für die Bundesrepublik Deutshland/Constitution of the Federal Republic of Germany), which states that this essence cannot be touched. This art. Much has been written about it and more will be written. This article was also included in our 1961 Constitution. This article was not included in the 1982 Constitution, but articles expressing similar elements (art. 12-15) were included. In that respect, it is still important and relevant in terms of Turkish Constitutional Law.
