Lack of specific provisions regarding judicial jurisdiction of Turkey in the Montreux Convention has led to emerge the question of whether foreign ships passing through Straits can be arrested. Another issue on which the doubts must also be eliminated is whether Turkey has a power in distraining on foreign ships passing through the Straits. In this study, both questions are tried to be answered in accordance with the provisions of the three conventions namely the Montreux Convention, the 1958 Geneva Convention on the Territorial Sea and the Contiguous Zone, the 1982 United Nations Convention on the Law of the Sea and attention is to be given to different opinions forwarded in academic circles and various court decisions. <br /> </p>}, number={1}, publisher={İstanbul Üniversitesi}
