In accordance with Article 107 of the 1982 Constitution, presidential decrees are the administrative acts that organizing the presidential administrative organization. For these decrees, applicability of the countersignature rule which has been envisaged in Article 105 and whether or not judicial review is available are debatable issues. In consideration of positive regulations, it should be said that this act is an administrative act that is subject to the countersignature rule from this it follows that these acts can be subject to administrative judicial review. This judicial review is conducted in terms of the elements of the decree. The act will be, according tho the quality of the deficiencies in its elements, either null or annulable. Also, as to the question of whether the presidential decrees need to be published, we must conclude that publication is required within the light of current provisions.
