The Code No: 6352, which is known as 3rd judicial package by the public opinion and entered into force after published in the Official Journal in 5 July 2012, has made amendments in a series of Laws, in particular including the Turkish Penal Code numbered as 5237. The Code No: 6352 has also made lots of amendments which has direct and indirect effects regarding the offence of unpaid utilization which is set out in the Article 163 of the Turkish Penal Code. As a result of these amendments, the scope of the offence of unpaid utilization has been broadened on the one hand; and the relationship between this offence and the offence of robbery, and the long standing debates that relate to this relationship has come to the fore again. This Article will examine the amendments of the Code No: 6352 which affect the offence of unpaid utilisation and their effects on the structure of this offence and analyse the positive and negative aspects of these amendments in the light of the problems that may be encountered in practice
Kamuoyunda 3. Yargı paketi olarak bilinen ve 5.7.2012 tarihinde Resmi Gazete’de yayımlanarak yürürlüğe giren 6352 sayılı Kanun, 5237 sayılı Türk Ceza Kanunu (“TCK”) ile birlikte birçok kanunda değişiklik getirmiştir. Bu kanun ile TCK’nın 163. maddesinde düzenlenmiş bulunan karşılıksız yararlanma suçunda da doğrudan ve dolaylı etki doğuracak birçok değişiklik yapılmıştır. Bu değişikliklerin sonucu olarak, bir yandan, karşılıksız yararlanma suçunun kapsamı genişletilmiş iken; diğer yandan da bu suç ile hırsızlık suçu arasındaki ilişki ve bu ilişkiye yönelik uzun zaman önce başlayan tartışmalar yeniden gündeme gelmiştir. Bu çalışmada da, 6352 sayılı Kanun’da karşılıksız yararlanma suçunu etkileyen değişikliklerin neler olduğu ve suçun yapısının nasıl değiştiği incelenerek, bu değişikliklerin olumlu ve olumsuz yönleri, uygulamada yaşanabilecek sorunlar çerçevesinde ele alınacaktır.
