                                                                                                <abstract><p>En Türkiye, comme dans d’autres pays, les fonctionnaires ont commencé à bénéficier de droits syndicaux plus tard que les employés du secteur privé. L’État a des obligations positives et négatives concernant les droits syndicaux, qui font partie des droits collectifs. La loi n° 4688 a été adoptée pour déterminer la portée et les limites des droits syndicaux. Le législateur a imposé des règles très restrictives sur les droits syndicaux des fonctionnaires, parfois contraire aux règles internationales sur les droits syndicaux. Outre la réglementation selon laquelle un nombre important de catégories de fonctionnaires ne bénéficieront pas des droits syndicaux, le droit de grève, qui est complémentaire aux droits syndicaux, n’a pas été accordé aux fonctionnaires. En effet, les règles de droit international autorisent aux Etats à porter des restrictions légitimes pour les membres des forces armées et de la police et les hauts fonctionnaires. Les dispositions restrictives de la loi conduisent à des décisions d&#039;annulation et de violation rendues par la Cour constitutionnelle à l’occasion de requêtes individuelles. Dans cette étude on va analyser le sujet en s’appuyant sur les réglementations nationales et internationales, la jurisprudence et la position doctrinale concernant le droit syndical des fonctionnaires.</p></abstract>

                            <p>Diğer ülkelerde olduğu gibi Türkiye’de de kamu görevlileri sendikal haklardan özel sektör çalışanlarına göre daha geç yararlanmaya başlamıştır. Kolektif hakların bir parçası olan sendikal haklar konusunda devletin pozitif ve negatif yükümlülükleri bulunmaktadır. Türkiye’de sendikal hakların kapsam ve sınırlarını belirlemek amacıyla 4688 sayılı Kanun kabul edilmiştir. Kanun koyucu, kamu görevlilerinin sendikal hakları konusunda, zaman zaman sendikal haklara ilişkin uluslararası kurallara aykırı olacak şekilde, çok kısıtlayıcı kurallar koymuştur. Kamu görevlilerinin önemli bir bölümünün sendikal haklardan yararlanamayacağı yönünde düzenleme yapılmasının yanı sıra, sendikal hakların tamamlayıcısı olan grev hakkı da kamu görevlilerine tanınmamıştır. Uluslararası hukuk kuralları, devletlerin silahlı kuvvetler mensuplarına, polis mensuplarına ve üst düzey yetkililere meşru kısıtlamalar getirmesine olanak tanımaktadır. Kanunda yer alan kısıtlayıcı hükümler, Anayasa Mahkemesi&#039;nin iptal kararları ve bireysel başvurularda ise ihlal kararları vermesine yol açmaktadır. Bu çalışmada kamu görevlilerinin sendikal hakları, ilişkin ulusal ve uluslararası düzenlemeler, içtihatlar ve doktrindeki görüşler ışığında incelenecektir.</p></trans-abstract>

                            <p>In Türkiye, as in other countries, civil servants began to benefit from trade union rights later than private sector employees. The state has both positive and negative obligations regarding trade union rights, which are part of collective rights. Law n° 4688 was accepted to determine the scope and limits of trade union rights. The legislator imposed highly restrictive rules on the trade union rights of civil servants, sometimes contrary to international regulations on trade union rights. In addition to the regulation stating that a significant number of civil servant categories will not benefit from trade union rights, the right to strike, which complements trade union rights, was not granted to civil servants. In fact, international law allows states to impose legitimate restrictions on members of the armed forces, the police, and high-ranking officials. The restrictive provisions of the law have led to annulment and violation decisions by the Constitutional Court in the context of individual applications. This study analyzes the subject based on national and international regulations, jurisprudence, and doctrinal positions regarding the trade union rights of civil servants.</p></trans-abstract>
