Although the history of labor inspection—one of the primary instruments capable of ensuring the effectiveness of labor law regulations—dates back quite far in our country, conducting a conceptual analysis of inspection and evaluating the outcomes of the inspection process through a holistic approach proves to be considerably challenging. This difficulty stems both from the significant influence of bureaucratic and legislative changes on the supervisory body, and from the limited number of academic studies on the subject. Therefore, within the scope of this study, the concept of labor inspection has been examined along the axes of its legal basis, the supervisory institution, and inspection practices. Following this analysis, considering the distinction between inspections concerning the execution of work and those regarding occupational health and safety, the legal implications of inspection reports prepared specifically in relation to the execution of work, as well as the potential judicial proceedings that may arise therefrom, have been evaluated. Finally, our views have been presented regarding administrative fines, which may appear as a potential consequence of legal non-compliance.
İş hukuku kurallarının etkinliğini sağlayabilecek başlıca araçlardan olan iş teftişinin geçmişi ülkemizde eskiye dayanmasına rağmen, teftişe dair kavramsal değerlendirme yapmak ve teftiş sürecinin sonuçlarını bütünsel bir yaklaşımla değerlendirmek, hem denetim örgütünün bürokratik ve mevzuata dair değişikliklerden oldukça fazla etkilenmesi hem de bu konuda yapılmış akademik çalışma sayısının azlığı nedeni ile hayli zorlayıcıdır. Bu nedenle çalışmamız kapsamında iş teftişi kavramı, hukuki dayanaklar, denetim örgütü ve teftiş uygulaması ekseninde incelenmiş, bu incelemeden sonra iş teftişinin işin yürütümü ve iş sağlığı ve güvenliği teftişleri olarak ikiye ayrıldığı dikkate alınarak, işin yürütümüne dair teftiş özelinde düzenlenecek iş müfettişi raporunun hukuki sonuçları ve bu sonuçlar karşısında yaşanabilecek yargısal süreçler değerlendirilmiş, son olarak hukuka aykırılığın olası bir sonucu şeklinde gözükebilecek idari para cezalarına karşın kanaatlerimiz aktarılmıştır.
