Giriş ve Hedefler Bu çalışma, Türkiye’de devlet ormanlarında yer alan yayla taşınmazlarının kira ödeme sistemine ilişkin hukuki, yönetsel ve mali sorunları analiz etmeyi amaçlamaktadır. Mevcut sistemin kamu yararı, eşitlik ve şeffaflık ilkeleri açısından zayıf yönlerini ortaya koyan çalışma, ulusal mevzuatın uygulamadaki etkilerini ve sistemin yeniden yapılandırılmasına yönelik politika ihtiyaçlarını da değerlendirmektedir.Yöntemler Araştırma, Devlet Ormanlarındaki Yayla Alanlarının İdaresi ve Tespiti Hakkında Yönetmelik başta olmak üzere 6831 sayılı Orman Kanunu, 2886 sayılı Devlet İhale Kanunu ve 4342 sayılı Mera Kanunu gibi düzenlemeleri Hans Kelsen’in normlar hiyerarşisi kuramı temelinde analiz etmektedir. Ayrıca 1973–2023 yılları arasındaki 31 Yargıtay kararı ve 3 Sayıştay raporu incelenmiştir. Saha verisi, bakanlık, STK ve yerel yönetim temsilcilerinden oluşan 18 uzmanla yapılan yarı yapılandırılmış görüşmelere dayanmaktadır. Elde edilen veriler MAXQDA yazılımı ile içerik analizine tabi tutulmuş ve yedi tematik başlık altında kodlanmıştır.Bulgular Çalışma, kira bedellerinin belirlenmesinde ölçülebilirlikten uzak kriterler kullanıldığını, ödeme tarihlerinin düzensizliğinin ve fiziki ödeme sisteminin uygulamada sorun yarattığını ortaya koymuştur. Ayrıca muhasebe sisteminde kurumsal bellek zayıflığı, veri izlenebilirliği eksikliği ve yaptırım mekanizmalarının uygulanmaması gibi sorunlar, sistemin yönetişim kapasitesini zayıflatmaktadır. Aynı yaylada orman içi ve dışı mülkiyet rejimlerinin birlikte uygulanması ise hukuki belirsizlik ve idari karmaşa doğurmaktadır.Sonuçlar Elde edilen bulgular doğrultusunda, merkezi dijital ödeme sistemine geçilmesi, sabit kira artış takviminin benimsenmesi, adil ve ölçülebilir kira belirleme kriterlerinin oluşturulması, muhasebe sisteminin mali milatla yeniden yapılandırılması ve coğrafi-tematik temelli bütüncül yayla yönetiminin tesis edilmesi önerilmektedir. Bu çalışma, yayla taşınmazları üzerinden kamu taşınmazı yönetiminde dijitalleşme, yönetişim kalitesi ve sosyal adalet ilkeleri bağlamında somut politika katkıları sunmaktadır.
Background and Aims This study aims to analyze the legal, administrative, and financial dimensions of the lease payment system for summer highland pasturelands located within state forests in Türkiye. It critically assesses the weaknesses of the current system in terms of public interest, equality, and transparency, and addresses the implementation effects of national legislation along with the need for a comprehensive policy restructuring.Methods The research adopts a normative legal analysis approach based on Hans Kelsen’s hierarchy of norms, focusing on key regulations including the Regulation on the Identification and Administration of Highland Pastures in State Forests, the Forest Law (No. 6831), the State Tender Law (No. 2886), and the Pasture Law (No. 4342). In addition, 31 Court of Cassation decisions (1973–2023) and 3 Turkish Court of Accounts reports were examined. Field data were obtained through semi-structured interviews with 18 experts from ministries, NGOs, and local administrations. Qualitative data were analyzed using MAXQDA software, and thematic coding was conducted under seven main categories.ResultsThe findings reveal significant shortcomings in the determination of lease values due to the lack of measurable and equitable criteria. Problems related to irregular payment timelines and a manual payment system also emerged. Furthermore, institutional weaknesses in the accounting system, such as poor traceability and data integrity, combined with ineffective enforcement mechanisms, undermine the governance capacity. The coexistence of different property regimes within the same pasture areas leads to legal ambiguity and administrative complexity.Conclusion Based on these findings, the study recommends the establishment of a centralized digital payment system, the implementation of a standardized annual lease increase calendar, the adoption of fair and measurable pricing models, the restructuring of the accounting system with a defined fiscal baseline, and the integration of a spatially and functionally unified governance model for pasturelands. Beyond its specific focus on highland pastures, the study offers policy implications for improving the overall management of public property in Türkiye by emphasizing digitalization, governance quality, and social justice principles.
