Both the Turkish and the German legislators have punished theft of use less severely than simple theft and have regulated it as a type of offence whose prosecution is subject to complaint. The offence of theft of use, which in the historical process was first regulated in the German Penal Code and then in the Turkish Penal Code with a special provision, is the subject of this study. While in German doctrine this provision is considered an independent offence, in Turkish doctrine it is considered a qualified element of the offence of theft, which reduces the punishment. The scope of the offence is different in the two laws. Similarly, theft of use is described differently in Turkish Penal Code No. 765 and Turkish Penal Code No. 5237. Our study compares the offence of theft of use in chronological order, taking into account the provisions of Paragraph 248b of the German Penal Code, Article 494(1) of the Turkish Penal Code No. 765 and Article 146 of the Turkish Penal Code No. 5237.
Hem Türk kanun koyucusu hem de Alman kanun koyucusu kullanma hırsızlığını hırsızlık suçunun temel şeklinden daha hafif cezalandırmış ve takibi şikayete bağlı bir suç tipi olarak düzenlemiştir. Tarihsel süreç içerisinde önce Alman Ceza Kanunu’nda (Alman CK) sonra ise Türk Ceza Kanunu’nda (TCK) özel bir hükümle düzenlenen kullanma hırsızlığı suçu bu çalışmada inceleme konusu yapılmıştır. Alman öğretisinde bahis konusu düzenleme müstakil bir suç olarak değerlendirilmekteyken, Türk öğretisinde hırsızlık suçunun cezayı azaltan nitelikli unsuru olarak değerlendirilmektedir. Her iki Kanun’da suçun konusu birbirinden farklıdır. Benzer şekilde 765 sayılı TCK ile 5237 sayılı TCK’da da kullanma hırsızlığı farklı şekilde düzenlenmiştir. Çalışmamızda, kronolojik bir sıra izlenerek kullanma hırsızlığı suçu, Alman CK § 248b, 765 sayılı TCK m. 494 bent 1 ve 5237 sayılı TCK m. 146 hükümleri dikkate alınarak karşılaştırmalı şekilde incelenmiştir.
