Payments of Social Security Institution which made to the insured or rights holders of such in various places in the Law no. 5510 are responsible for the actual payment of the institution is responsible for jointly, is regulated. Joint liability in the sense of the law is against the Institution. The Institution may request all or part of the person who is jointly responsible for claiming, for example, the employer, the employer’sdelegate and the senior manager together and by applying to one of them. The issue of joint liability has not been examined in detail in terms of the provisions and results of the Law no. 5510, in which the joint liability organization will be dealt with in the dimension of social security taking into account the regulations in general provisions
5510 sayılı Kanunda muhtelif yerlerde Sosyal Güvenlik Kurumunun sigortalı veya hak sahiplerine yaptığı ödemeler sebebiyle söz konusu ödemelerden asıl sorumlu olan kişilerin Kurum karşısında birlikte, müteselsilen sorumlu oldukları düzenlenmiştir. Kanun anlamında müteselsil sorumluluk Kuruma karşıdır. Kurum, alacağını talep edebilmek için müteselsilen sorumlu olan kimselere örneğin, işveren, işveren vekili, üst düzey yöneticiye birlikte veya içlerinden birine başvurmak suretiyle alacağının tamamını veya bir kısmını talep edebilir. Müteselsil sorumluluk konusu 5510 sayılı Kanunda hüküm ve sonuçları açısından detaylı bir şekilde incelenmemiş olup, bu çalışmada müteselsil sorumluluk kurumu genel hükümlerdeki düzenlemelerde dikkate alınarak sosyal güvenlik hukuku boyutu ile ele alınacaktır
