Bu çalışma, Türkiye’de Kamu Toplu İş Sözleşmeleri Çerçeve Anlaşma Protokollerinin tarihsel gelişimini, hukuki niteliğini ve bağlayıcılığını değerlendirmek amacıyla kaleme alınmıştır. 1960’lı yıllardan itibaren gerek devlet gerekse özel sektör işverenleri, ekonomik dalgalanmaları kontrol altına almak ve toplumsal talepleri yönetmek amacıyla toplu pazarlığı merkezileştirme eğilimi göstermiştir. Özel sektörde grup toplu iş sözleşmeleri aracılığıyla gerçekleşen merkezileşme, kamu işçileri bakımından ise kamu toplu iş sözleşmeleri çerçeve anlaşma protokolü ile somutlaşmıştır. 1989’da imzalanan ilk protokol, ücret politikalarını ve çalışma ilişkilerini uzun vadede etkileyen bir dönüm noktası olmuştur. Başlangıçta yalnızca “centilmenlik anlaşması” olarak görülen ve hukuken bağlayıcı sayılmayan bu protokoller, taraflar arasında bir tür koordinasyon işlevi üstlenmiştir. Ancak 2017 tarihli 696 sayılı KHK ile protokollere bağlayıcılık kazandırılmış, bu durum konfederasyonların toplu pazarlıkta daha belirleyici hale gelmesine yol açmıştır. Bu gelişme sendika özgürlüğü, toplu pazarlık hakkı ve grev özgürlüğü açısından önemli tartışmaları beraberinde getirmiştir. Anayasa Mahkemesi’nin 2023 tarihli kararıyla, yalnızca sendikaların toplu iş sözleşmesi yapabileceğine dikkat çekilerek 2017 öncesi uygulamaya dönülmüştür. Çalışma, protokollerin kamu kesiminde farklı işverenler bünyesinde çalıştırılan işçilerin mali ve sosyal haklarını uyumlaştırmadaki önemini vurgulamakla birlikte, hukuki statülerinin 6356 sayılı Kanun’un benimsediği ilkelere ve sistemine uyumlu bir zemine oturtulması gerektiğini savunmaktadır.
This study has been written to examine the historical development, legal nature, and binding effect of the Public Collective Bargaining Agreement Framework Protocols in Turkey. Since the 1960s, both the state and private sector employers have shown a tendency to centralize collective bargaining to control economic fluctuations and manage social demands. While such centralization in the private sector was realized through group collective agreements, in the public sector it took shape with the framework protocols. The first protocol, signed in 1989, marked a turning point that influenced wage policies and labour relations in the long term. Initially regarded merely as a “gentlemen’s agreement” without legal enforceability, the protocols primarily served as coordination instruments between the parties. However, with Decree Law No. 696 of 2017, they were granted binding force, which shifted the bargaining power toward confederations. This development triggered major debates on union freedom, collective bargaining rights, and the right to strike. With its 2023 decision, the Constitutional Court emphasized that only trade unions are entitled to conclude collective agreements, thereby restoring the pre-2017 framework. While highlighting the protocols’ role in harmonizing the financial and social rights of workers employed under different public employers, the study argues that their legal status should be aligned with the principles and structure adopted by Law No. 6356.
