Devletler, hak sahibi oldukları inancıyla ihtilaflı deniz alanlarında tek taraflı olarak eylemler gerçekleştirmektedir. Bu tür tek taraflı eylemler, Doğu Akdeniz’de olduğu gibi genellikle diğer kıyı devletleri arasındaki anlaşmazlığa neden olmaktadır. Sınırları ihtilaflı deniz alanlarında devletlerin uluslararası hukuktan doğan yükümlülükleri mevcuttur. Devletler uluslararası hukuk kapsamında üstlenilen yükümlülükleri iyiniyetle yerine getirmekle ve uluslararası hukukta tanınan hakları, yetkileri ve serbestileri hakkın kötüye kullanımı teşkil etmeyecek şekilde kullanmakla yükümlüdürler. Bu yükümlülüklere aykırı devlet uygulamaları ise iyi komşuluk gereklerine aykırılık teşkil etmektedir. Çalışmada, sınırları ihtilaflı deniz alanlarında devletlerin uluslararası hukuktan doğan yükümlülüklerinden hareketle Doğu Akdeniz’deki uyuşmazlığın hukuki boyutu ele alınmakta ve bu yükümlülüğe aykırı davranışlar neticesinde Türkiye Cumhuriyeti Devleti’nin denizci devlet olmaya yolunda bilhassa 2011 yılından itibaren attığı adımlara değinilmektedir.

States carry out unilaterally actions in disputed maritime areas, believing that they are entitled. Such unilateral actions often cause disputes between other coastal states, as in the Eastern Mediterranean. In the maritime areas zones with disputed boundaries states have obligations arising from international law. States are obliged to fulfil their obligations under international law in good faith and to exercise the rights, jurisdictions and freedoms recognized in international law in manner which would not constitute an abuse of right. State practices contrary to these obligations constitute a violation of good neighbourly requirements. In the study, the legal aspects of the conflict in the Eastern Mediterranean are discussed based on the obligations of states arising from international law in maritime areas with disputed borders, and the steps taken by the Republic of Türkiye to become a maritime state especially since 2011 as a result of acts contrary to this obligation are mentioned.
