                            <p>The implications of sea-level rise for maritime boundary delimitations established under international law have become increasingly apparent. Since such boundaries are inherently dependent on coastal geography, they are directly affected by the physical changes driven by climate change. In this context, the doctrine of “rebus sic stantibus” -fundamental change of circumstances - as codified in the law of treaties, has reemerged as a central question regarding the validity of maritime delimitation agreements. This article offers a comprehensive assessment of the concept of baselines under the United Nations Convention on the Law of the Sea (UNCLOS) as well as the legal stability of treaties, state practice, and the jurisprudence of international courts and tribunals. It further discusses the future of existing delimitation arrangements in light of the need to safeguard international peace and legal certainty.This article argues that the ambulatory character of the normal baseline remains the lex lata, that the deposit &amp; publicity practice before the UN Secretary-General may produce a de facto fixing effect in certain settings, yet maritime delimitation treaties remain insulated from rebus sic stantibus under VCLT art. 62(2)(a). The findings indicate that administrative recording does not amount to normative change and that the finality of existing delimitation treaties should be preserved.</p></trans-abstract>
                                                                                                                                    <abstract><p>Deniz seviyesindeki yükselmelerin, uluslararası deniz hukukunun temelini oluşturan deniz yetki alanı sınırlandırmalarına yönelik etkileri gün geçtikçe daha görünür hale gelmektedir. Özellikle antlaşmalarla belirlenen deniz sınırlarının coğrafi koşullara bağlılığı, bu sınırların iklim değişikliğinin tetiklediği fiziksel değişikliklerden doğrudan etkilenmesi sonucunu doğurmaktadır. Bu bağlamda, antlaşmalar hukukunda düzenlenen “esaslı değişiklik” (rebus sic stantibus) ilkesi, deniz sınırlandırma antlaşmalarının geçerliliği bakımından yeniden gündeme taşınmaktadır. Çalışmada, Birleşmiş Milletler Deniz Hukuku Sözleşmesi (BMDHS)’nin esas hat kavramı ile birlikte antlaşmaların hukuki istikrarı, devlet uygulamaları ve uluslararası yargı kararları ışığında kapsamlı bir değerlendirmeye tabi tutulmaktadır. Ayrıca, uluslararası barışın ve hukuki güvenliğin korunması bağlamında mevcut sınırlandırmaların geleceği tartışılmaktadır.Bu çalışmada, yürürlükteki pozitif hukuk bakımından normal esas hattın hareketli (ambulatuar) niteliğinin korunduğu, Birleşmiş Milletler Genel Sekreteri (BMGS) nezdindeki aleniyet kazandırma &amp; tevdi etme (deposit &amp; publicity) pratiğinin bazı coğrafyalarda fiilî bir sabitleme (fixing) etkisi doğurabildiği; bununla birlikte deniz sınırlandırma antlaşmalarının Viyana Antlaşmalar Hukuku Sözleşmesi (VAHS) m. 62/2(a) uyarınca rebus sic stantibus’a kapalı olduğu tezi sınanmaktadır. Bulgular, hareketli rejimin lex lata olarak sürdüğünü; idari-teknik kayıt ve ilan mekanizmalarının normatif tadil oluşturmadığını; mevcut sınırlandırma antlaşmalarının nihailiğinin ise korunması gerektiğini göstermektedir.</p></abstract>
