The Republic of Türkiye’s first Climate Law entered into force after being published in the Official Gazette on 9 July 2025. With the adoption of the Law, a new era has begun in Türkiye’s climate policies. This article aims to provide an introductory analysis of the Law. Rather than offering a provision-by-provision examination of the Law, which in total consists of twenty provisions, the present article seeks to illuminate the content and the spirit of the Law. On 29 October 2021, the Directorate of Climate Change was established as an affiliated body of the Ministry of Environment, Urbanization and Climate Change through the Presidential Decree No. 85. The Law clearly assigns the primary role in combating climate change to the Directorate of Climate Change. The Law introduces significant regulations concerning the principles to be observed by the Directorate in the battle against climate change, as well as planning and implementation methods and the carbon pricing system. The first section of this article presents a comparative analysis of the purpose of the Law. The second section examines the principles adopted by the Law in addressing the climate crisis. In this context, principles guiding the battle against the climate crisis—such as common but differentiated responsibilities and respective capabilities, sustainability and precautionary principles—as well as mitigation targets and adaptation policies, are analysed in detail. The third section of the article focuses on the planning and implementation methods established by the Law. Within this framework, particular attention has been paid to the objective of strengthening local governance, the Emissions Trading System, and penal provisions.
Türkiye’nin ilk İklim Kanunu 9 Temmuz 2025 tarihinde Resmî Gazete’de yayımlanarak yürürlüğe girmiştir. 7552 sayılı İklim Kanunu’nun yürürlüğe girmesi ile birlikte Türkiye’nin iklim politikalarında yeni bir dönem başlamıştır. Bu çalışma, zikredilen kanunun giriş niteliğinde bir analizini sunma amacını haizdir. Toplamda yirmi maddeden oluşan Kanundaki her bir maddenin teker teker analizinden ziyade, Kanunun içeriğinin ve ruhunun aydınlatılması hedeflenmiştir. Kanun, iklim değişikliği konusunda temel rolü, 29 Ekim 2021 tarihinde 85 sayılı Cumhurbaşkanlığı Kararnamesi ile Çevre, Şehircilik ve İklim Değişikliği Bakanlığı’na bağlı bir kuruluş olarak kurulan İklim Değişikliği Başkanlığı’na vermiştir. Kanun, Başkanlığın iklim değişikliği ile mücadelede dikkate alacağı prensiplere, planlama ve uygulama yöntemlerine ve karbon fiyatlandırma sistemine ilişkin önemli düzenlemeler getirmiştir. Eldeki çalışma, önümüzdeki günlerde sıkça tartışılacak olan 7552 sayılı Kanunun giriş niteliğinde bir analizini sunmayı amaçlamaktadır. Çalışmanın ilk bölümünde Kanunun amacının karşılaştırmalı bir analizi sunulmuştur. İkinci bölümde ise Kanunun iklim krizi ile mücadelede benimsediği esaslar incelenmiştir. Kriz ile mücadelede benimsenen prensipler (örneğin, ortak fakat farklılaştırılmış sorumluluklar ve göreceli kabiliyetler, sürdürülebilirlik ve ihtiyatlılık ilkeleri) ve ek olarak azaltım hedefleri ve uyum politikaları bu bölümde ayrıntılı bir şekilde incelenmiştir. Üçüncü bölümde ise Kanunun planlama ve uygulama yöntemleri ele alınmıştır. Bu kapsamda ise Kanunda yer alan yerelin güçlendirilmesi hedefine, Emisyon Ticaret Sistemine ve cezai hükümlere yer verilmiştir.
