This study includes the introduction of the work named ‘at-Tekmîl fil-Usûl’ written by Vecihuddîn Omer b. Abdulmuhsin al-Erzincani as an annotation to Pazdawî's Usûl, which is one of the main works of Hanafi fiqh method and includes evaluations examining the understanding of qiyas. In the field of Islamic law procedure, Vecihuddin Omer b. Abdulmuhsin al-Erzincani The work named et-Tekmîl fil-Usûl written by Abdulmuhsin al-Erzincânî in 726 is one of the manuscripts in this field. It is an annotation to 's Usûl, which is one of the main works of Hanafi fiqh. Erzincânî's work has been described as an exemplary study in the field of fiqh. Although Et-Tekmîl fil-Usûl was written with the method and technique of Pazdawî, it is a work that emerges with Erzincani's unique ideas, views, examples, and evaluations from time to time. After citing Pazdawi's text, Erzincani states his opinions, thoughts, and evaluations, starting with the words ‘I’d say, too’. He emphasizes that qiyas is definitely included in the law based on a wisdom, and one of the methods of understanding and comprehending the decrees of the shar'i is qiyas. In the work, it is explained with justification that qiyas is one aspect of the original and another aspect of the analogy. Qiyas has been evaluated as fer’, since the Qur'an did not make any provision like sunnah and ijma at the beginning. Since the book, the sunnah and the consensus are solid proof, and qiyas is conjectural evidence, it has been examined in the fourth place apart from the three solid proofs. The field of our study is the qiyas part of the work named at-Tekmîl fil-Usûl. The reason why we do such a study is to examine how the chapter of qiyas is handled in terms of Islamic law procedure in Erzincani's work and to determine its parallel and different approaches to the traditional method.
Bu çalışma Hanefî fıkıh usûlünün temel eserlerinden olan Pezdevî’nin Usûl’üne şerh olarak Vecihüddîn Ömer b. Abdülmuhsin el-Erzincani tarafından yazılmış ve kıyas anlayışını inceleyen değerlendirmeleri içermektedir. İslâm hukuk usulü alanında hicri 726 da Vecihüddîn Ömer b. Abdülmuhsin el-Erzincani tarafından yazılmış “et-Tekmîl fil-Usûl” isimli eser, bu alandaki el yazma nüshalarından birisidir. et-Tekmîl fil-Usûl Pezdevî’nin usul ve yöntemi ile yazılmış olmakla birlikte yer yer Erzincani’nin kendine has fikir, görüş, örnek ve değerlendirmeleriyle ortaya çıkan bir çalışmadır. Erzincani, Pezdevî’nin metnini zikrettikten sonra “ekulü/ ben de derim ki” diye söze başlayarak görüş düşünce ve değerlendirmelerini belirtir. Kıyasın mutlaka bir hikmete binaen teşride yer aldığını, şer‘î hükümleri anlama ve idrak etme yöntemlerinden birinin de kıyas olduğunu vurgular. Eserde kıyasın bir yönü ile asıl, bir yönü ile de fer‘ olduğu gerekçeli olarak açıklanmıştır. Kıyas, Kur’an sünnet ve icma gibi başlangıçta bir hüküm koymadığından fer‘ olarak değerlendirilmiştir. Kitap, sünnet ve icma kati, kıyas ise zanni bir delil olduğundan üç kati delilden ayrı olarak dördüncü sırada incelenmiştir.Çalışmamızın alanı Et-Tekmîl fil- Usûl isimli eserin kıyas bölümüdür. Böyle bir çalışmayı yapmamızın nedeni Erzincani’nin eseri içerisinde kıyas babının İslâm hukuk usulü açısından nasıl işlendiğini incelemek, geleneksel usule paralel ve farklı yaklaşımların tespiti yapılmaya çalışılacaktır. Bu çalışma Erzincani’nin şerhi bağlamında fukaha metodu üzerine yazılan Pezdevî’nin Usûl’ündeki kıyas üzerinden, şârihin alana yaptığı katkıları ortaya çıkarmaktır. eser müellifi tarafından alanında örnek bir çalışma olarak nitelendirilmiştir.
