Öz

Çocuk askerler konusu yeni bir konu değildir. Konu silahlı çatışmaların başlangıcından itibaren gündemde olan
bir konudur. Batı ülkeleri menşeli yabancı çocuk askerlerin Irak ve Suriye’de savaşmak üzere Irak Şam İslam
Devleti Örgütü (ISID) tarafından eğitilmesi ile birlikte çocuk askerler konusu yeni bir boyut kazanmıştır.
Afrika’daki uluslararası niteliği olmayan silahlı çatışmalarda karşımıza çıkan çocuk askerlerden önemli ölçüde
farklı olan yabancı çocuk askerler konusu değişik boyutları ile Uluslararası Hukuk ve ulusal hukuk tarafından ele
alınmaktadır. Bu düzenlemelerde yabancı çocuk askerlere klâsik çocuk askerlerden farklı bir kovuşturma
yaklaşımı sergilenmektedir. Makalede klâsik çocuk askerler ve yabancı çocuk askerler arasındaki fark ortaya
konularak yabancı çocuk askerlerin hukuki statülerine ilişkin olarak Uluslararası Hukuk ve ulusal hukuk
seviyesinde yapılan tartışmalara ve düzenlemelere ışık tutulmaktadır.
