Tarih boyunca devletler, uyguladıkları politikalar doğrultusunda toplumsal tepkilerle karşı karşıya kalabilmişler ve bununla baş edebilmek adına buldukları çözüm yollarını yasal zemine dayandırmışlardır. Bu durum Cumhuriyet rejimine geçişle Türkiye’de de yaşanmış; ülkenin farklı yerlerinde yeni sisteme ve sistemin getirisi olan uygulamalara karşı hareketlenmeler görülmüştür. Bu hareketlenmeler kimi zaman kısa süre içinde ve bölgedeki kolluk kuvvetlerinin müdahalesiyle durdurulabilmiştir. Kimi zaman da daha geniş çapta müdahalede bulunulması zorunluluğu doğmuştur. Mevcut sıkıntının giderilebilmesi için uygulanacak müdahalelere karşı durulmaması ve bir an önce huzur ortamının sağlanması adına askeri idarenin kendini gösterdiği süreçlere “Örfi İdare/Sıkıyönetim” adı verilmiştir. Önceki yıllarda Kanun-ı Esasi’de ve 1921 Anayasası’nda görülen konuya ilişkin anayasal düzenlemeler, Cumhuriyet sonrasında ilk olarak 1924 Anayasası’nda yerini almış; akabinde gerek 1961 gerekse 1982 Anayasalarında ilgili maddelere yer verilmiştir. 1925’ten itibaren devletin işleyişini zora sokan süreçlerde ve darbe dönemlerinde başvurulan Sıkıyönetim, bazı il veya bölgelerde kısmi olarak yahut bütün yurt genelinde uygulanmıştır. Hazırlanan çalışmada Takrir-i Sükun’dan Olağanüstü Hal’e uzanan süreçteki uygulamalara yer verilmiştir. Devletin ve milletin asayiş ve güvenliğinin sağlanması adına gerek görüldükçe başvurulan bu uygulamalar kronolojik biçimde işlenmiştir. Çalışmanın başlıklandırılması Anayasalar temelinde şekillendirilmiş; mevcut sorunların iyileştirilmesi adına yasal düzende gösterilen çabalardan ayrı hukuki metinlerde gidilen dönemsel düzeltmeler üzerinden bir yazım gerçekleştirilmiştir.
Throughout history, states have faced reactions from society due to their policies. They have found legal solutions to cope with this. This situation has also been experienced in the Republic of Turkey; movements against the new system and the practices that this system brought were seen in different parts of the country. These movements could sometimes be stopped in a short time and with the intervention of the security forces in the region. Sometimes, the state had to intervene on a larger scale. In order to prevent the interventions to be implemented in order to solve the existing problem and to ensure that peace was immediately established, support was received from the military administration. These processes were called “Martial Law”. Articles on the subject exist in all Turkish Constitutions. Martial Law, which was applied in processes that made the functioning of the state difficult and in coup periods starting from 1925, was applied partially or throughout the country in some provinces or regions. The prepared study includes the applications in the process from Takrir-i Sükun to the State of Emergency in Turkey. These applications, which were applied, when necessary, in order to ensure the order and security of the state and the nation, were processed chronologically. The study is divided into sections based on the Constitutions. A writing was carried out on the periodic corrections made in separate legal texts from the efforts made to improve the existing problems within the framework of the legal order.
