                                                                                                <abstract><p>Bu makale, nomos empsychos (yaşayan yasa) kavramının entelektüel kökenine dair daha geniş kapsamlı bir araştırmanın ikinci bölümünü oluşturmaktadır. İlk makale, bu kavramın antik Yunan felsefesindeki ortaya çıkışını izleyip, geç antik dönem ve erken Hıristiyan düşüncesinde geçirdiği dönüşümü takip ederken, bu çalışma Orta Çağ ve modern bağlamlarda yaşayan kanunun sürekliliği, değişimi ve yeniden yorumlanmasına odaklanmaktadır. Makale, kapsamlı bir vaka analizi sunmak yerine, nomos empsychos motifinin klasik kökenlerinin ötesindeki sürekliliğini göstermek için kronolojik ve kapsamlı olmayan bir yaklaşım benimsemektedir. Makalenin temel argümanı, yaşayan hukukun tarihinin, teolojik kavramların sekülerleşmesi ve modern hukuk ve siyaset düşüncesinde siyasi teolojinin kalıcı varlığı gibi daha geniş bir sürecin parçası olarak anlaşılabileceğidir. Bu bağlamda makale, modern devlet teorisinin tüm önemli kavramlarının sekülerleştirilmiş teolojik kavramlar olduğu yönündeki Carl Schmitt’in iddiasını tartışmaktadır. Ayrıca, çalışma, özellikle Eugen Ehrlich’in hukuk sosyolojisinde geliştirdiği “yaşayan hukuk” kavramının, daha önceki nomos empsychos geleneği ile anlamlı bir şekilde ilişkilendirilip ilişkilendirilemeyeceğini kısaca incelemektedir. Nomos empsychos düşüncesinin kavramsal yaşam öyküsünü ve soy kütüğünü tamamlamaya çalıştığımız bu ikinci makale, bu fikrin modern dönemde de ortadan kalkmadığını veya kavramsal olarak geçerliliğini yitirmediğini iddia etmektedir. Böylelikle çalışma, öncelikle hukuk felsefesi, siyasal ilahiyat, hukuk tarihi ve egemenliğin kavramsal temelleri üzerine mevcut literatüre katkıda bulunmayı hedefler.</p></abstract>
                                                                                                                                                                                    <trans-abstract xml:lang="en">
                            <p>The relationship between democracy, monarchy and the concept of living law further emphasizes the enduring importance of nomos empsychos. Although this concept is most clearly expressed within monarchical and imperial frameworks where law is embodied in the figure of the ruler, it would be misleading to view it as incompatible with democratic thought. On the contrary, the historical origins of living law reveal that democracy and monarchy are not opposing solutions, but rather different responses to the same structural problem: the gap between abstract law and effective authority. In democratic contexts, this gap is managed through institutions, procedures, and collective practices that seek to “animate” the law without personal embodiment. In contrast, in monarchical systems, law is animated through an individual who claims to embody justice, reason, or divine will. Thus, living law points to a common concern rather than being a regime-specific anomaly, illuminating how both democratic and monarchical orders grapple with the necessity of giving life to normativity. From this perspective, nomos empsychos reveals the limits of the simple opposition between the supremacy of law and the supremacy of people, inviting a more nuanced understanding of how legal authority is maintained in different political forms. The article’s main argument is that the history of living law can be understood as part of a broader process, including the secularization of theological concepts and the enduring presence of political theology in modern legal and political thought. In this context, the article discusses Carl Schmitt’s claim that all key concepts of modern state theory are secularized theological concepts. Furthermore, the study briefly examines whether the concept of “living law,” developed by Eugen Ehrlich in legal sociology, can be meaningfully linked to the earlier tradition of nomos empsychos. This second article, which attempts to complete the conceptual life story and genealogy of the nomos empsychos idea, argues that this concept has not disappeared in the modern era or lost its conceptual validity. Thus, the study aims to contribute to the existing literature primarily on legal philosophy, political theology, legal history, and the conceptual foundations of sovereignty.</p></trans-abstract>
