Regulated in Article 277 of TCK (Criminal Code of Turkey), the offense of attempting the influence judicial bodies, expert and witness appears in the second section regulating “Offenses against the Judicial Bodies or Court”, of the fourth chapter titled “Offenses against Nation and State and Final Provisions”, of the second volume titled “Special Provisions” of Criminal Code of Turkey No. 5237. The offense in question, which presents a safeguard for judicial independence regulated in article 138 of the constitution, forms one of the most significant provisions included in the criminal code. While regulating the said offense, the law-maker has brought about substantial amendments to extend the scope of application for the article. Thus, the offense discussed in the study was approached in the light of judicial decisions and through comparison with former provisions of law.
